The licensing inspectors conducted an unannounced complaint inspection in response to a complaint that was received by the licensing department on 09/16/2016 regarding allegations of inappropriate staff supervision of children. The inspection was initiated and completed on 10/25/2016. On 10/25/2016, the inspectors was on site from 1:00pm to 2:45pm. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details. Standard #: 22VAC40-185-340-A Complaint related: Yes Description: Based on staff interview on 10/25/2016 the center did not ensure that the care, protection and guidance of the children in care was guaranteed. EVDENCE: 1. Staff #4, (who works with the preschool age children) stated that while on lunch break, on 09/13/2016 or 09/14/2016, Staff #1 (who works with the infant and toddler age children) and Staff #4 were drinking alcoholic beverages. Staff #4 stated that Staff #1 returned to work on that day. 2. Staff #4 stated that two to three times in the past they have had an alcoholic drink while on lunch break. Staff #4 stated they have returned to work because they did not feel intoxicated. Plan of Correction: Staff will have disciplinary action to include counseling and time in the street.
Standard #: 22VAC40-185-350-D Complaint related: No Description: Based on observation on 10/25/2016, the center did not ensure that during the designated rest period the ratio of staff to children was double the number of children to each staff required. EVIDENCE: There were 13 children observed sleeping in the preschool area with one staff member. The youngest child in this group was 22 months. The ratio for children 16 months old to two years: one staff member for every five children. Plan of Correction: Will continue to have staff in place at all times and not leave building until ratio is met.
Standard #: 22VAC40-185-350-E-1 Complaint related: No Description: Based on observation on 10/25/2016, the center did not ensure that the applicable ratio of one staff member for every four children for children from birth to the age of 16 months was followed. EVIDENCE: Upon the inspectors' arrival there were nine infants and toddlers with one staff member in the infant room. Plan of Correction: Will continue to have staff in place at all times and not leave building until ratio is met.
Standard #: 63.2-1720-F Complaint related: No Description: Based on observation, staff interview, and review of staff records on 10/25/2016, the center did not ensure that an employee shall be permitted to work in a position that involves direct contact with a person or child receiving services until an original criminal record clearance or original criminal history record has been received, unless such person works under the direct supervision of another employee for whom a background check has been completed. EVIDENCE: 1. Staff # 2 was observed working in the infant and toddler room alone. Staff #2's date of hire was 10/13/2016 and there was no documentation of the results of the criminal history record in Staff #2's record. Staff # 5 stated that criminal history record had not been returned yet. 2. Staff #3 was observed working in the preschool room alone. Staff #3's date of hire was 10/4/2016 and there was no documentation of the results of the criminal history record in Staff #3's record. Staff # 5 stated that criminal history record had not been returned yet. Plan of Correction: Will continue to have staff in place at all times. Will not leave the building.
