22VAC40-191 Background Checks (22VAC40-191)
The licensing inspector conducted an unannounced renewal inspection from 9:30am - 1:00pm. There were eleven children in care: three infants with one staff and eight children ages 17 months to 5 years with two staff. One additional staff was also present. The children were observed playing with blocks, watching a cartoon and during lunch. Four staff, three children's and four board officer's records were reviewed. Violations from the previous inspection were also reviewed and all had been corrected. Areas of non-compliance are identified on the violation notice. Standard #: 22VAC40-185-570-A Description: Based on observation, the center failed to fasten a protective belt around a child in a high chair. Evidence: 1. The inspector observed lunch time. One child was placed in a high chair and the tray was connected; however, the protective belt was not fastened. Plan of Correction: When the director was made aware that the protective belt had not been fastened, the director told the staff person who was supervising and the staff person fastened the protective belt around the child.
Standard #: 22VAC40-191-40-D-1-C Description: Based on record reviews, the center failed to obtain repeat background checks prior to the three year expiration dates. Evidence: 1. The inspector reviewed four staff's records. Two of four records reviewed (staff records #1 and #2) contained criminal history record checks that were over three years old. Both staff record #1 and staff record #2 contained criminal history record checks that were dated 02/05/2013. The inspector reviewed four board officer's records. Three of four records reviewed (board officer record #1, #2 and #3) contained background checks that were over three years old. Board officer record #1 contained a search of the central registry that was dated 12/18/2012 and a criminal history record check that was dated 12/17/2012. Board officer record #2 contained a search of the central registry that was dated 12/18/2012 and a criminal history record check that was dated 12/27/2012. Board officer record #3 contained a search of the central registry that was dated 12/18/2012 and a criminal history record check that was dated 12/17/2012. All sworn disclosure statements were current. Plan of Correction: Upon further review, staff #1's and staff #2's current criminal history record checks were located. This was after the inspector had left. Board Officers #1, #2, #3 all now have current criminal history record checks on file. We are waiting for the return of the central registry searches for all three board officers. Our program has a new Human Resource Director and policies will be implemented to assure background checks are kept in compliance with licensing requirements.
