22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitoring inspection was conducted from 11:50 a.m. to 2:35 p.m. At the time of entrance the following adult to child ratios were observed: 9 children, 3 years old, with 1 staff (nap period) 14 children 2 1/2 to 5 years old, with 1 staff (nap period) 7 toddlers, 17 months to 2 years old, with 2 staff 3 infants, 7 to 12 months old, with 1 staff The records sample size consisted of 3 children?s records and 3 staff records. Children were observed resting quietly on mats at nap time, infants and toddlers were observed sleeping on mats or in cribs and being held and rocked. Medication administration was not observed. The director states that there no medication is administered to children in care at this time. Transportation was not observed. However, the vehicle was inspected and standards regarding transportation and field trips were reviewed. Eight recent accident / incident reports for minor injuries were reviewed. Areas of non-compliance are identified on the violation notice. Thank you for your time during today's inspection. Please do not hesitate to contact me if I may be of assistance. The licensee provided verbal responses to the violations during the inspection, which were entered on to the violation notice by the Licensing inspector.
Standard #: 22VAC40-185-140-A Description: Based on a review of records and interview, the licensee did not ensure that each enrolled child has a physical examination by or under the direction of a physician before attending the center or within one month after attendance began. Evidence: Three children's records were reviewed. The record for child #1 did not contain documentation of the results of a physical examination by or under the direction of a physician. The director stated that she had requested this documentation from child #1's parent and the parent had indicated that a physical was already scheduled but she never turned in the written documentation of the results. Plan of Correction: The director will contact the parent today to request that she submit the written results of the physical examination by no later than the end of next week.
Standard #: 22VAC40-185-70-A Description: Based on a review of records, the licensee did not ensure that each staff has a record which contains documentation that two or more references as to character and reputation as well as competency were checked before working in the center. Evidence: Three staff records were reviewed. The record for staff #1 who began employment on 1/30/17 contained documentation of only one of the two required references to be checked before working in the center. The program director acknowledged that only one reference had been obtained. Plan of Correction: The program director stated that she would inform staff #1 today that a second written reference must be obtained and submitted for the record within 1 week.
Standard #: 22VAC40-185-280-E Description: Based on observation, the licensee did not ensure that cleaning materials (e.g., detergents, sanitizers and polishes) and insecticides/pesticides shall be stored in areas physically separate from each other. Evidence: The licensing inspector observed a locked storage closet which contained a variety of cleaning materials located on the same shelf as an aerosol bottle of wasp repellent. Plan of Correction: The wasp repellent was relocated to a locked storage shed outside of the center during the inspection. Insecticides will be stored outside of the center from now on to ensure they are kept separate from cleaning materials.
