- Technical Assistance:
The inspector and director discussed the importance of sending background checks out in a timely manner and following up on background checks which take longer than 30 days. We also discussed the importance of consistency of teachers in the classroom and to limit the amount of staff floating from classroom to classroom. The inspector reviewed the requirements for lead teachers per group or class with the director.
A complaint investigation was received on January 25, 2017 and was initiated on January 31, 2017 regarding supervision, and care and safety of children. Interviews were conducted. Documentation was reviewed. There was not a preponderance of evidence to support the allegation regarding supervision and care and safety of children. Standard #: 22VAC40-185-70-A Complaint related: No Description: Based on record review, two staff records were not complete. Evidence: Staff 5 and Staff 6 did not have staff records on file at the center. Staff 5 has a record but it has not yet been transferred to the center. Staff 6 is from a staffing agency and did not have a record at the center. The information missing includes but is not limited to emergency contact for staff member, documentation of references, start date, and education transcripts. Plan of Correction: Principal has transferred staff records on file to the center.
Standard #: 22VAC40-185-240-A Complaint related: No Description: Based on record review, two staff did not receive training by the end of their first day of assuming job responsibilities.. Evidence: Based on an interview with the Director, Staff 5 and 6 did not have documentation indicating review of the policies. Plan of Correction: The staff record on file shows training completed on the first day of assuming job responsibilities.
Standard #: 22VAC40-191-40-C-1-B Complaint related: No Description: Based on record review, one staff member did not have a criminal history record check on file and two staff members did not have a sworn statement completed on their date of hire. Evidence: Staff #4 (hire date 07/2016) did not have criminal history record check on the date of inspection. A criminal history record check was sent out in July 2016 but on the date of inspection the results were not returned. Upon interview, the director indicated she had not yet followed up. Staff 5 (hire date 1/30/2017) and Staff 6 (hire date 1/30/2017) did not have a sworn statement completed on their date of hire. Plan of Correction: Principal will contact the agency in charge of the criminal check to see the status of the background check results.
Standard #: 22VAC40-191-60-C-1 Complaint related: No Description: Based on record review, an employee was not denied continued employment when the center did not have an original criminal history record report for an employee within 30 days. Evidence: Staff #4 (hire date 07/2016) did not have criminal history record check on the date of inspection. A criminal history record check was sent out in July 2016 but on the date of inspection the results were not returned. Upon interview, the director indicated she had not yet followed up to check the status of why the background check was not returned. Staff #4 was not denied continued employment until the criminal history record report was returned. Plan of Correction: After 3/31/2017, if there is no status update of the criminal background check employee will be denied employment.
