22VAC40-185 PROGRAMS.

Comments:
The licensing inspector conducted an other inspection on 01/10/2017, and 01/01/2017 in response to a self-reported incident that was received in the Valley Licensing Office on 01/04/2017. The on-site portion of the inspection was unannounced and conducted on 01/10/2017 from 11:00 a.m. to 1:00 p.m. Three (3) staff members and two (2) school employees were interviewed. One (1) child's record and two (2) staff member's were reviewed. The inspection was in regards to the licensing standards relating to the care, protection and guidance of children, behavior guidance and forbidden actions. The violations of the licensing standards relating to the incident can be found on the violation notice. A findings review was conducted on 02/17/2017. Please complete the columns for ?Plan of Correction? and "Date To Be Corrected" for each violation cited on the violation notice and return it to the licensing office no later than 03/04/2017. Violations:
Standard #: 22VAC40-185-340-A
Description: Staff B failed to ensure the care, protection and guidance while supervising children. Evidence: Based on the viewing of a video, Staff B failed to intervene to protect Child A. 1. Staff B witnessed Child A being yelled at by Staff A. 2. Staff B witnessed Staff A flicking a child's arm at least five times. 3. Staff B witnessed Staff A swat at Child A. 4. Staff B witnessed Staff A grab Child A's wrist and forcefully jerk the child thrusting his ribs into the table. 5. Staff B witnessed Staff A roughly pick Child A up and forcefully place him on the floor two times.

Plan of Correction: Staff was fired immediately. Doors to the classrooms are open for supervision. Retrained all staff on inappropriate care/supervision and on whistle blower policy.

Standard #: 22VAC40-185-400-B
Description: Staff A failed to use constructive behavior guidance that was age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts. Evidence: Based on the viewing of a video, two toddler children were touching one another's shirts at the table. Staff A was observed yelling "No!" "Stop!" "Oh God!"

Plan of Correction: Staff was fired immediately. Staff was retrained on age/stage appropriate behavior and how to redirect when there is a conflict.

Standard #: 22VAC40-185-410-1
Description: Staff A was observed striking and rough handling a child. Evidence: Based on the viewing of a video, Staff A was observed 1."Flicking" a child on the arm at least five times. 2. Swatting a child on the arm. 3. Forcefully jerking a child's right wrist and thrusting his ribs into the table. The child was observed holding his right abdomen immediately after the incident. 4. Picking up a child under the arms and roughly placing him on the floor two times.

Plan of Correction: Staff was fired immediately. Staff was retrained on our whistle blower policy. Staff was retrained on the policy we never put our hands on a child.
