Comments:
The Licensing Inspector for Happy Feet Early Learning Center & Child Care conducted an unannounced complaint inspection in response to allegations received by the licensing office on 11/17/2017. Interviews were conducted with children and staff, classrooms were observed, records were reviewed and the facility was inspected relating to allegations of physical abuse, insufficient adult-to-child ratios and unclean facilities. The inspection was initiated on 11/29/2016, findings were reviewed on 12/07/2016 investigation concluded on 3/20/2017. As the information gathered during the investigation support the allegations, the complaint is determined to be ?VALID.? In addition, there were violations found that were unrelated to the complaint. Please complete the columns for ?description of action to be taken? and ?date to be corrected? for each violation cited on the Violation Notice and then return a signed and dated copy to the Licensing office within 5 calendar days of receipt. Description: Based on record review & discussion with the Center Director, the Licensee failed to maintain and keep at the center a separate record for each child enrolled. EVIDENCE: Records were unavailable for Child #1, Child #2, Child #3 and Child #4.

Plan of Correction: Director will implement a new filing system to make sure all files are accredited for and kept confidential at all times

Description: Based on observations, staff interviews & record review, the Licensee failed to ensure during the designated rest period, the ratio of staff to children my only be doubled if the number of children to each staff required by 22VAC40-185-(5)-350-E-2 (16 mos to 2 yrs; one staff/5 children) is met. EVIDENCE: During the designated rest period, LI Anderson observed twelve (12) children of mixed ages under the direct supervision of one (1) staff member. ages 20 months. There was at least one (1) child under the age of 2 years old. Ratios were not maintained according to the youngest child in care.

Plan of Correction: The Director will monitor each room closely making sure that all rooms are within ratio at all times.

Complaint related: Yes
Description: Based on interviews, the Licensee failed to ensure physical punishment, striking a child, roughly handling or shaking a child is not used to punish children. EVIDENCE: During interviews, Staff Member #2 stated that physical punishment was in fact used on Child #1. Staff Member #2 demonstrated how a plastic box (see pictures) was used to tap Child #1 on the head when the child is playing rough with the other children. Staff Member #3 stated that this physical abuse was practiced frequently. Staff Member #3 observed abuse on various occasions by various staff members. Director advised she issued a notice of disciplinary action to Staff Member #2 for physical abuse.
