An unannounced focused inspection was conducted on 2/10/17 in response to a self reported incident of inappropriate discipline of a child, which was received in the licensing office on 2/7/17. The investigation was initiated on 2/8/17. Center Staff and the child's parent were interviewed, 1 staff record and 1 children's record were reviewed. Documentation to include center policies and procedures, staff training, incident reports and various written reports and statements regarding the reported incident were also reviewed. Violations were cited with regard to the reported incident in the areas of Inappropriate Discipline (Corporal Punishment) and Operational Responsibilities. Standard #: 22VAC40-185-410-1 Description: Based on a review of documentation and interviews, the licensee did not ensure that forbidden actions do not occur at the center, to include physical punishment or striking a child. Evidence: According to interviews and written documentation, on February 21, 2017 at 7:35 a.m. child #1(DOB 6/13/15) arrived at the center and entered the toddler classroom with her mother. At the time of child #1's arrival staff #1 was working alone with one other toddler in her care. All sources confirm that upon drop off the child became upset and was "having a fit", "throwing a tantrum", "kicking running and falling out". Child #1's parent states that since child #1 was having a difficult time, she went to the classroom next door to see if child #1 could be cared for in the classroom where staff #2 was working because her child is very close with staff #2. After talking with staff #2, the parent walked back to the toddler classroom to check on child #1. The parent states that she witnessed staff #1 "Hitting her child's hand". Written documentation completed directly following the incident shows that Child #1's parent reported to the center owner that staff #1 "popped" her child's hand. Staff #1's own written documentation following the incident says that she "tapped her left hand out of reflex" when child #1 "lashed out by slapping me in the face". When interviewed, child #1's parent stated that she witnessed staff #1 hitting her child's hand repeatedly / several times. When asked to describe how she hit the child's hand and asked if she recalled saying in her earlier statement that staff #1 "popped" her child's hand, the mother stated that she "did pop her child's hand, but that is still hitting". The parent went on to say that she hit her child's hand more than once which she felt was not indicative of a "reflex" reaction to the child slapping staff #1's face. Plan of Correction: Staff #1 was placed on administrative leave during an internal investigation at the center, returned for a brief period but was eventually terminated on 4/19/17. A staff training was held regarding appropriate discipline measures on March 13 and the correct methods for handling misbehavior were reviewed at this time. Staff will adhere to center policies and licensing standards when disciplining children or redirecting inappropriate behavior.
