Comments:
An "other" type inspection was made on 5/18/17 in response to an incident that was reported to the Division of Licensing Programs by the center director on 5/15/17. The inspection was made with staff from the local social services agency. During this inspection the video was viewed, the staff person's record was reviewed, the child's record was reviewed, and the child was interviewed. The inspection took place during the regular monitoring inspection which took place from 8:45 am until 4:30 pm.

Violations:
Standard #: 22VAC40-185-410-1
Description: Based on review of a video recording and interviews, the center failed to ensure that the forbidden actions (physical punishment, striking a child, roughly handling or shaking a child, etc.) listed in the Standards were not used for a child in care at the center. Evidence: 1. A video recording provided by the center's internal surveillance system of an incident on 5/12/17 was viewed at the center on 5/18/17. The video showed a staff person using her foot to physically move a child (7 years old) by shoving the child in the lower back who was sitting in the floor. 2. The child was interviewed on 5/18/17 and this interview supported what was shown in the video. The child stated that the staff person shoved her while saying, "Now move!" in a tone that scared the child. The child stated that it hurt her back and scared her. According to the mother of the child, there was no visible injury to the child.

Plan of Correction: The center immediately (on 5/12/17) took personnel action for the staff person. The director addressed the incident with all other staff on the evening of 5/12/17 including forbidden actions. The director made changes to the supervision of the school-age children by separating the ages by smaller age groups. The director will review this incident, the outcome, and the testing of the change in supervision of school-age children at the May 30 staff meeting.
