22VAC40-191 Background Checks (22VAC40-191)

The Licensing Inspector conducted a joint investigation with a local agency in response to a self-reported incident of a child left out of sight and sound supervision on 10/18/17. Interviews were conducted with staff. Children and staff records were reviewed. Based on the preponderance of evidence gathered during this investigation, violations were cited. The violations were discussed with the center director. Please complete the columns for "Plan of Correction" and "Date to be Corrected" for each violation cited on the violation notice, and then return a signed and dated copy to the licensing office within 5 calendar days of receipt. Standard #: 22VAC40-185-40-E
Description: Based on staff interviews and documents reviewed, the center did not ensure it's activities and services were maintained in compliance with the center's own policies and procedures that are required by licensing standards. Evidence: On 10/18/17 at approximately 11:13am, Staff # 1 and Staff # 2 did not follow the center's own procedures for identifying where children are at all times. Staff # 1 and 2 did not conduct a name to face count before leaving the facility to go to the playground. Additionally, neither staff documented the name to face count on the attendance sheet when the group of children was divided in two, to go outside at separate times.

Plan of Correction: Both staff have been re-trained on Bright Horizon's transition tracking policy.

Description: Based on staff interviews and record review, staff did not ensure care, protection, and guidance of children. Evidence: 1. On 10/18/17, the preschool class had a total of 14 children with 2 staff members. Staff # 1 took 8 children outside as Staff # 2 waited inside with 6 children, for Child # 1 to finish using the bathroom. After Child # 1 finished using the bathroom, another child asked Staff # 2 for help. During this time, Child # 2 (3 years old) went to use the bathroom without Staff # 2 being aware. Staff # 2 lined up the children and only counted 5 children. Staff # 2 assumed that the sixth child had gone outside with Staff # 1. Staff # 2 did not do the required name to face count and did not check the classroom and bathroom to confirm the whereabouts of Child #2. At approximately 11:13 am Staff # 2 took the group of 5 children outside to the playground. 2. When leaving the classroom to go to the playground, Staff # 2 did not have an attendance sheet on which the name to face count would have been documented. 3. At 11:15 am Staff # 3 entered the preschool room and found Child # 2 alone and unsupervised. The child was left out of sight and sound supervision for less than two minutes. Child # 2 told Staff # 3 that Staff # 2 left her in the bathroom. While Staff #3 was speaking to Child #2, Staff # 2 came into the room and took Child # 2 to the playground.

Plan of Correction: All staff received retraining on transition tracking on 11/10/17.

Standard #: 22VAC40-185-340-F
Description: Based on staff interviews and written documentation, staff did not maintain sight and sound supervision of the children in care. Evidence: On 10/18/17 at approximately 11:13 am Staff # 2 left Child #2 (3 years old) in the preschool classroom when the other children in the group were taken to the playground. Staff # 2 was not aware that Child # 2 had gone to use the bathroom. When the children were lined , he only counted 5 children. Staff # 2 assumed that Child # 2 went outside with Staff #1. Staff #2 did not complete the required name to face count on the attendance sheet. Staff # 2 took the 5 children outside, leaving Child # 2 in the bathroom. At approximately 11:15am Child # 2 was found alone and unsupervised in the classroom by Staff # 3. The child was left out of sight and sound supervision for approximately two minutes.

Plan of Correction: All staff received retraining on sight and sound supervision.
