22VAC40-191 Background Checks (22VAC40-191)

An unannounced monitoring inspection was completed on 11/28/2017. There were 17 children, ages 7 months-5 years, and 4 staff present during today's inspection. The inspector reviewed 5 children's records and 4 staff records. This facility does not administer medication. The children were observed in the following activities: free choice play, music and movement time, story time, lunch, and nap. Infants were observed being fed and allowed to sleep on demand. Proper hand washing, diapering and table sanitizing were observed during the inspection. The inspector reviewed the updated emergency preparedness plans and emergency supplies. The inspector discussed the following with the staff: ways to track attendance/departure, storing personal items, background check requirement updates and upcoming emergency drills. An exit conference took place at the conclusion of today?s inspection. The inspector arrived at 10:15 a.m. and departed at 1:50 p.m. Thank you for your time today. Standard #: 22VAC40-185-270-A
Description: Based on observation, the facility failed to keep all areas and equipment of the center, inside and outside, clean, safe and operable. Evidence: 1. The plastic playhouse on the playground has a rusted protruding screw that could snag skin as well as chipping and peeling paint. 2. The steering wheels on the red car-like piece of equipment are loose and when moved creates a pinch-point.

Plan of Correction: The Director will call the Owner and have the repairs done.

Standard #: 22VAC40-185-280-C
Description: Based on observations, the facility failed to ensure that pesticides or insecticides shall not be stored in areas used by children or in areas used for food preparation or storage. Evidence: The inspector observed 3 bottles of Round-Up (2 smaller bottles and one large sprayer) , 2 bottles of Hot Shot (1 small bottle and one large sprayer) and one bottle of Spider & Ant Killer located on a shelf beside of the washer/dryer in the kitchen of the facility.

Plan of Correction: The Director removed the items during the inspection and stored them in the basement.

Standard #: 22VAC40-185-330-B
Description: Based on observation, the facility failed to maintain the required amount of resilient surfacing in the area where the playground equipment is provided. Evidence: 1. The piece of play equipment with the slide did not have 6" of mulch (the resilient surfacing used at this facility). There was less than 1" of mulch around the climbing area of the piece of equipment. 2. There was hole approximately 6" deep at the bottom of the slide that did not contain any resilient surfacing.

Plan of Correction: The Director will contact the Owner and request more mulch.

Standard #: 22VAC40-191-60-C-1
Description: Based on record review, the facility failed to obtain a criminal history record report within 30 days of employment. Evidence: The record for Staff #2 has a documented hire date of 5/15/2017. The original criminal history record report is dated completed by the Virginia State Police on 7/19/2017.

Plan of Correction: The Director will document when background checks are sent off and returned.
