63.2 Child Abuse and Neglect

Comments:
An unannounced monitoring inspection was conducted on 11/27/17 to investigate a self reported allegation that a staff person hit a child on the arm. The incident took place on 11/16/17. Interviews were conducted. Based on the preponderance of evidence, violations were cited. Areas of non-compliance are identified in the violation notice. Violations:
Standard #: 22VAC40-185-400-B
Description: Based on staff interviews, staff did not use behavioral guidance that was age and stage appropriate, and constructive in nature.
Evidence:
1. On 11/16/17, at approximately 4pm, as snack time was concluding, Child # 1 (8 years of age) took her water bottle and began pouring water into the trash can before throwing away the bottle. Staff # 1 asked Child #1 to stop pouring the water out because it could cause a leak. Child # 1 did not stop and continued to pour water into the trash. In response, Staff # 1 raised her hand and slapped Child #1 on the upper left arm. After being slapped Child #1 threw the water bottle in the trash and returned to her table.

Plan of Correction: Staff will ensure that age and stage appropriate guidance is provided when interacting with children.

Standard #: 22VAC40-185-410-1
Description: Based on staff interviews, staff used a forbidden action of physical punishment when striking a child in care. Evidence: 1. On 11/16/17, at approximately 4pm, as snack time was concluding, Child # 1 (8 years of age) took her water bottle and began pouring water into the trash can before throwing away the bottle. Staff # 1 asked Child #1 to stop pouring the water out because it could cause a leak. Child # 1 did not stop and continued to pour water into the trash. Staff # 1 raised her hand and slapped Child #1 on the upper left arm. 2. Staff # 2 was seated at a table right across from Staff # 1. Staff # 2 stated that they heard and saw Staff # 1 slap Child # 1's upper left arm. Staff # 2 stated that after she witnessed the incident, she looked at Staff # 3 and quietly asked if Staff # 1 hit Child # 1. Staff # 2 stated that Staff #3 said yes. 3. Staff # 3 stated that they heard and saw Staff #1 slap Child # 1's upper right arm. Staff # 3 stated that she walked over to Staff # 2 and asked her if she witnessed the incident. Staff # 3 stated that Staff # 2 said yes. Staff # 3 also stated that Child # 1 looked shocked and appeared as if she wanted to cry. 4. After snack was over, Staff # 1 took a group of children to the playground. Staff # 2 and 3 remained in the classroom with the rest of the children, including Child # 1. Staff # 3 asked Child #1 if Staff # 1 hit her. Staff # 3 stated that Child # 1 replied yes.

Plan of Correction: Staff # 1 has been advised that under no circumstance is physical punishment ever permitted or tolerated.
