Comments:
An investigation was initiated on 2/8/18 in response to a complaint received by the Eastern Regional Office on 2/8/18 regarding supervision. An unannounced on-site inspection was conducted on 2/22/18 and interviews with staff were conducted. Records and documentation related to the incident were also reviewed. Based on the information gathered during the investigation, the evidence does not support the allegations so the complaint is determined to be NOT VALID. Two violations not related to the complaint are identified on the violation notice and were discussed with the center director.

Complaint related: No
Description: Based on record review and interview, the center did not ensure that each child shall have a physical examination by or under the direction of a physician before the child's attendance or within one month after attendance. Evidence: 1. The record for child #1 does not contain documentation of a physical examination. Child #1 has a date of enrollment of 11/16/16 and was in care on the day of the inspection. 2. Staff #1 confirmed there was no documentation of a physical examination in child #1's record.

Plan of Correction: The center responded with the following: Parent has withdrawn her child from our program. Effective immediatly, management will ensure that a system is in place to ensure that physical forms are updated as needed to meet standards.

Complaint related: No
Description: Based on record review and interview, the center did not ensure that each staff member shall submit documentation of a negative tuberculosis screening no later than 21 days after employment and shall have been completed within 12 months prior to employment. Evidence: 1. Staff #2 has a date of hire of 11/27/17. The record for staff #2 contains a tuberculosis screening dated 10/21/16, which is more than 12 months prior to employment. Staff #2 was caring for children on the day of the inspection. 2. Staff #1 confirmed the documented tuberculosis screening for staff #2 was completed more than 12 months prior to employment.

Plan of Correction: The center responded with the following: Employee was sent 2/23/18 for an updated TB. Management has been retrained as of 2/23/18 on the requirements for employment regarding TB testing, and they will verify all documents during on boarding to ensure compliance.
