22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitoring inspection was conducted today from 10:30am-1:45pm. A total of 43 children were observed in the care of 10 staff. Children were observed during outdoor play, handwashing, and toileting. Pasta with children and sausage, butternut sauce, salad and fresh fruit were served for lunch. Infant diapering and handwashing were also observed. 6 out of 7 classrooms were inspected. A sample of 6 staff records, 5 children's records, medications, emergency drills and other documents were reviewed. Areas of noncompliance are documented one the violation notice. Standard #: 22VAC40-185-400-B Description: Based on observation, behavioral guidance was not constructive in nature or age and stage appropriate. Evidence: Upon inspector arrival, a child was observed not responding to staff's verbal cue to get in line in order to transition indoors from the outdoor play area. Staff #3 was then observed grabbing the child's wrist and pulling them to the line. Plan of Correction: The staff member will be counseled.
Standard #: 63.2-1721.1-B-3 Description: Based on a sample review of records, 2 staff records were missing results of child abuse and neglect registry or equivalent registry maintained by any other state in which the staff have resided in the preceding five years. Evidence: Staff #1 [date of hire 3/19/18] disclosed on a sworn disclosure statement that they have resided in West Virginia within the past five years. Staff #2 [date of hire 3/19/18] also disclosed on a sworn statement residing in Washington [state] and New York within the past five years. Neither record contain results of central registry findings from those states. Plan of Correction: Inspector reviewed Adam Walsh website with Director. We will mail forms off today to request out of state background checks.
