22VAC40-185 STAFFING AND SUPERVISION.
The licensing inspector initiated an unannounced complaint inspection in the center on April 16, 2018, continued on April 30, 2018 and completed on June 6, 2018 in response to a complaint received by the licensing office regarding programs and staffing/supervision. Interviews with staff members and parties involved were conducted. Based on observations, a review of video recordings and a review of center documentation available during the investigation, a preponderance of evidence does support the allegation regarding staffing/supervision therefore the complaint is determined to be VALID. Standard #: 22VAC40-185-340-A Complaint related: Yes Description: Based on video recording and staff interviews, the licensee did not ensure the care, protection, and guidance of the children. Evidence: On April 11, 2018 at approximately 4:21pm, a video recording showed children and staff lining up at the exit gate of the center's playground and then exiting the playground. Two children, Child #1, age 3 and Child #2, age 4 were observed alone on the playground playing at the base of the slide chute. At approximately 4:23 pm, the video recording showed, Child #1 and Child #2 walking alone into the building from the playground. Staff #3, in the building, observed Child #1 and Child #2 waking down the hallway from the playground entrance door and she asked them what happened. The children said "they left us". Staff #3 took Child #1 and Child #2 to meet their designated classroom teachers, who were in the hallway. Staff #1 and Staff #2 were unaware the children were missing. Plan of Correction: The center director will retrain staff and has added a new hourly count sheet to the daily routine. Disciplinary actions were taken one staff was terminated and the other was retrained and can not be left alone with children for 90 days. The center director will reevaluate the staff after 90 days.
Standard #: 22VAC40-185-340-F Complaint related: Yes Description: Based on video recording and staff interviews, the licensee did not ensure children under 10 years of age are always within actual sight and sound supervision of staff. Evidence: The center's video recording confirms on April 11, 2018 from approximately 4:21 pm until 4:23 pm, Child #1, age 3 and Child #2, age 4 were without sight and sound supervision of a staff member. They were left alone on the center's playground while their classmates and teachers, Staff #1 and Staff #2 went inside. Plan of Correction: The center director will retrain staff and has added a new hourly count sheet to the daily routine. Disciplinary actions were taken one staff was terminated and the other was retrained and can not be left alone with children for 90 days. The center director will reevaluate the staff after 90 days. All other center staff were retrained and now use hourly count sheet for their routine.
