22VAC40-191 Background Checks (22VAC40-191)
An unannounced renewal inspection was completed today. The physical plant, 5 staff files (plus 8 new hires' fingerprint checks), 5 children's files, annual fire and health inspection, staff training, child nutrition, children's activities, medications, emergency procedures, drills and supplies were inspected between 1:30-4:15pm. There were 102 children under the supervision of 14 staff. During the inspection, children were observed having tummy time (infants), coloring, working on crafts, completing math worksheets, reading books and resting during naptime. For lunch, the children were served chicken pasta primavera, broccoli, cantaloupe and milk. The interactions between the children and staff were seen to be positive and constructive in nature. Standard #: 22VAC40-185-130-B Description: Based on file review, 2 out of 5 children's records do not have additional immunizations every six months up to the age of 2 years. Evidence 1. Child #4 is 25 months old. The most recent immunization record was updated when the child was 14 months old. 2. Child #5 is 28 months old. The most recent immunization record was updated when the child was 15 months old. Plan of Correction: We will ask parents for these.
Standard #: 22VAC40-185-160-C Description: Based on file review, 1 out of 5 staff records do not have a TB test/screening completed within the past two years. Evidence 1. Staff #1's most recent TB test/screening on file was completed on 7/22/15. Plan of Correction: Staff #1 brought this into the center, but it was not found. Staff #1 will have the doctor's office provide another copy.
Standard #: 22VAC40-185-60-A Description: Based on file review, 2 out of 5 children's records do not have all required information. Evidence 1. Children #3 and #5 do not have addresses for the two emergency contacts. Plan of Correction: We will have the parents complete this.
Standard #: 22VAC40-185-70-A Description: Based on file review, 2 out of 5 staff records do not have all required information. Evidence 1. Staff #2, #4 and #5 do not have documentation that two or more references as to character and reputation as well as competency were checked before employment began. Plan of Correction: These will be completed.
Standard #: 22VAC40-185-550-D Description: Based on file review, the center did not implement an evacuation drill each month. Evidence 1. There was no documentation of a drill having been completed in June 2018. Plan of Correction: This will be completed and documented.
Standard #: 22VAC40-185-570-E Description: Based on observations, there were bottles of infant formula which were not labeled with the dates. Evidence 1. In the Older Infant room, there were two bottles that were not labeled with the dates. Plan of Correction: The teacher immediately added this to the bottles.
Standard #: 22VAC40-191-60-C-2 Description: Based on file review, 2 out of 5 staff records do not have a completed search of the central registry (SCR) within 30 days of employment. Evidence 1. Staff #4 has been employed for more than 30 days, as she began employment on 9/19/17. 2. Staff #5 has been employed for more than 30 days, as she began employment on 11/6/17. 3. There is no completed SCR for staff #4 or #5 and no documentation of any follow up with the agency regarding the searches. Plan of Correction: Based on the Code of Virginia, these employees must be denied continued employment until the searches are received.
