22VAC40-185 STAFFING AND SUPERVISION.
- Technical Assistance:
The licensing inspector conducted an unannounced complaint inspection on 7/9/18 in response to a complaint received by our department on 6/25/18. The inspector was on site from 10:00 AM to 11:00 AM. The allegations of the complaint were inadequate staff-to-child ratios, improper behavioral guidance and forbidden actions. Classroom observations were made, interviews were conducted, and records were reviewed. The preponderance of the evidence gathered during the investigation supports two of the allegations and the complaint is determined valid. See the violation notice for more detail. Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return it to the licensing office within 5 business days. Your plan of correction should contain 1) steps to correct the non-compliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).
Standard #: 22VAC40-185-350-C Complaint related: Yes Description: Based on information obtained during the inspection, the center did not ensure staff to children ratio requirements applicable to the youngest child in the group were followed when children were regularly in mixed age groups. Evidence: 1. The licensing inspector observed a staff to child ratio of 12:1 in the school age room. The licensing inspector conducted staff interviews and reviewed child records to determine that two of the children in the classroom were not school age. Child #1's date of birth is 10/18/13 and Child #2's date of birth is 12/30/13. These two children will not meet the age of eligibility to attend public school, which is five years old by September 30, 2018. The ratio should have been 10:1. 2. The licensing inspector observed a staff to child ratio of 10:1 in the class the teacher described as 2's and 3's. The licensing inspector spoke with the director about the class ratio and the director stated that the two year olds in this class are at least two and a half. The ratio should have been 8:1. Plan of Correction: Per the director, "Staff will double check child's birthday before moving up to visit."
Standard #: 22VAC40-185-400-B Complaint related: Yes Description: Based on staff interviews and observation the facility did not ensure that behavioral guidance was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior. EVIDENCE: Interviews were conducted with staff confirming that the facility employs behavioral guidance described as having children "stand on a block." The inspector observed the style of block used, which is a boundary produced by tile flooring in which adult-sized shoes could fit inside of comfortably. This use of behavioral guidance does not meet the requirements of being constructive in nature, being age and stage appropriate, nor being used to redirect children to appropriate behavior. Plan of Correction: Per the director, "Staff will still continue to use redirection and time out as a last resort. If time out is used, child will sit in a chair at a table."
