22VAC40-191 Background Checks (22VAC40-191)

An unannounced monitoring inspection was conducted on June 1, 2018 relative to a self-reported incident regarding Programs. An inspection was completed at the facility, observations were completed in the classroom, interviews were conducted with staff and other collateral witnesses and documentation was reviewed and obtained. Areas of noncompliance are identified on the Violation Notice.

Standard #: 22VAC40-185-340-F
Description: Based on staff and collateral interviews and inspection of the facility, the licensee did not ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff. Evidence: During the inspection conducted on June 1, 2018, Child #1, a preschool age child, was out of sight and sound supervision of staff for an undetermined amount of time when an incident occurred on May 22, 2018. The child was taken out of the classroom and into the hallway by a non-staff member. An interview with staff confirmed "the door was open" and "we had hearing but not sight" of the child and the non-staff member.

Plan of Correction: A Sign-out/Sign-in sheet will be available for non-staff members who will be providing services to any student out of the Head Start classroom. Update policies/procedures to ensure that all staff are aware of contracted services. Management staff will provide clearance to center Director of any non-staff services that require children to be removed from the classroom.

Standard #: 22VAC40-191-40-D-3-B
Description: Based on review, staff interviews and inspection of the facility, the licensee did not ensure that the center would obtain satisfactory background checks for independent contract employees or contract employees hired by contract agencies before they begin providing services at facilities. Evidence: During the inspection conducted on June 1, 2018, the center had not obtained a fingerprint check or conducted a search of the Central Registry for Contract employee #1who had been alone with and in control of at least one child in care on May 22, 2018.

Plan of Correction: Staff will ensure that contractors submit satisfactory background check and the Central Registry prior to rendering services to any student enrolled in the Head Start Program.
