Comments:
The inspector conducted an inspection based on a self-reported incident that was reported to this office concerning a supervision issue of a child. Based on record review and interviews, the incident was found to be substantiated. Areas of non-compliance are identified on the violation notice. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on record review, the licensee failed to ensure that the center's activities and services are maintained in compliance with the standards, the center's own policies and procedures that are required by these standards. Evidence: 1. The inspector reviewed the agency's policies of supervision of children. On 5/10/18 a child was left outside on a porch that the class had been playing on for approximately 5 minutes. Staff #1 did not follow Supervision of Children policy, which includes head count procedures.

Plan of Correction: Staff #3 was immediately removed from the site. After reviewing video coverage, the staff member was terminated but resigned before termination process could begin. The management team developed a training review of all safety policies and went to each of the six early head start and head start centers and gave a training to all staff within three days of the incident. The agency phone policy was revised to limit further the use on any phones while supervising children. These policy procedures have been sent to licensing.

Description: Based on record review and interview, staff failed to ensure the care, protection, and guidance while supervising children. Evidence: 1. On 5/11/18 staff #1 stated to the inspector that a child under three years of age had been left out on a porch at the center after the class had been playing on it. 3. Staff #2 supplied a written account of video coverage. This report stated that staff #3 goes out the door with three children at 3:30 p.m. At 3:33 p.m. staff #3 re-enters the classroom with two children. Staff #3 is observed talking on a phone. At 3:36 p.m., staff #3 discovers that child #1 is not in the classroom. She searches the room for child #1. At 3:38 p.m. staff #3 takes two children with her out on the porch and finds child #1 on the porch and re-enters the classroom with all three children. Child #1 had been out of sight and sound supervision for 5 minutes.

Plan of Correction: The day the incident was reported, an extra gate was installed between the porch and the ramp for added security. Other sites were assessed for the need for gates. Staff person #3 was immediately removed from the site. After reviewing the video coverage, staff member was terminated but resigned before termination process could begin. Management team delivered a training to every staff person on child supervision.

Description: Based on record review and interview, the center did not always keep a child under ten years of age within actual sight and sound supervision. Evidence: 1. Staff #1 stated that a child under three years of age had been left out on a porch at the center after the class had been playing on it. 3. Staff #2 supplied a written account of video coverage. This report (based on video coverage) stated that staff #3 goes out the door with three children at 3:30 p.m. At 3:33 p.m. staff #3 re-enters the classroom with two children. Staff #3 is observed talking on a cell phone. At 3:36 p.m., staff #3 discovers that child #1 is not in the classroom. She searches the room for child #1. At 3:38 p.m. staff #3 takes two children with her out on the porch and finds child #1 on the front porch and re-enters the classroom with all three children. Child #1 had been out of sight and sound supervision for 5 minutes.

Plan of Correction: Staff #3 was immediately removed from the site. After reviewing video coverage, the staff member was terminated but resigned before termination process could begin. The day of the incident was reported, an extra gate was installed between the porch and ramp for extra security. All other sites were assessed for the need for gates or additional security features. Management team delivered a training to every staff member on child supervision. A revised telephone policy has been developed.
