22VAC40-191 Background Checks (22VAC40-191)

Technical Assistance:
Discussion of the newly obtained finger print checks for all current staff. These national background checks replace the criminal record checks done through the state and are good for 5 years. In addition, the existing search of the central registry (CPS) checks and Sworn Disclosure Statements (SDS) are retroactively good for 5 years. As a reminder, new employees will not be allowed to start until an ?Eligibility Letter? is on file, and any new staff person who lives or has lived outside of the Commonwealth of Virginia within the past 5 years will need to have an out-of-state CPS check completed and placed in their file as well.

The following inspection took place between the hours of 10 am through 1 pm. Today, I met with the Kinder Care Learning Center located in the town of Leesburg, Virginia. At the start of this unannounced monitoring inspection there were a total of 48 children with 8 staff; good ratios in all 6 rooms. A total of 5 children?s files and 4 staff files were reviewed. The children were engaged in the following: large motor skilled play outside on center playground, art, music, diapering, hand washing, games, field trip to the movies, lunch, nap time, and other organized activities. Standard #: 22VAC40-185-130-B
Description: Based on review, 1 of 5 children's files reviewed indicated that the center did not obtain documentation of additional immunizations once every six months for children under the age of two years. Evidence - 1. On the date of inspection (07/19/2018), an updated immunization page for Child #2 was not available for review. 2. The most current immunization page on file for Child #2 was dated 01/02/2018. 3. Based on the information on file, on the date of inspection, Child #2 was under the age of two years.

Plan of Correction: An updated immunization page for Child #2 shall be request from the parent.

Standard #: 22VAC40-185-140-A
Description: Based on review, 2 of 5 children's files reviewed indicated that each child did not have a physical examination (by or under the direction of a physician) within one month after attendance. Evidence - 1. On the date of inspection (07/19/2018), documentation of a physical examination was not available for review for the following children: Child #2, and Child #4. 2. The start date for Child #2 was listed as 01/02/2018. The start date for Child #4 was listed as 01/02/2017. 3. Both Child #2, and Child #4 were observed to be in attendance on the date of inspection.

Plan of Correction: The parents of both children shall be contacted and a physical shall be obtained.

Standard #: 22VAC40-185-60-A
Description: Based on review, 2 of 5 children's files reviewed indicated that not all of the required information/documentation was contained within each child's record. Evidence - 1. On the date of inspection (07/19/2018), the addresses for the two emergency contacts listed for both Child #4 and Child #5 were not available for review. 2. All other information with regards to the two listed emergency contacts (name, and phone number) was listed.

Plan of Correction: All missing information shall be obtained and placed in the applicable child's file.

Standard #: 22VAC40-185-570-E
Description: Based on observation, 3 of 18 refrigerated bottles were not correctly labeled. Evidence - 1. On the date of inspection (07/19/2018), three (3) bottles located in a refrigerator within the Infant room was labeled with a child's name, but without today's date. 2. Staff within this room stated that these 3 bottles were dropped on today.

Plan of Correction: Corrected on the date of inspection. Staff removed the bottles and finished labeling them correctly.
