22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitoring inspection was conducted on 7/26/18 from 10:30 am until 1:45 pm. At the time of the inspection 21 children were present with five staff members. The sample size consisted of five staff's records, five children's records, one child's medication and supporting documents, one child's diaper ointment, and four children's sunscreen. Children and staff were observed during structured play, an art project, bathroom break, hand washing, preparing for lunch, lunch, nap, transitions, and behavioral management. The violations from the previous inspection were reviewed for current compliance. One repeat violation was found. The violations found during this inspection are listed on the violation notice. Standard #: 22VAC40-185-140-A Description: Based on record review and interview, the administrator failed to obtain documentation of one out of five children's physical examination prior to attendance or within 30 days after attendance.
1. The record for child 5, start date 6/7/18), did not contain documentation of a physical examination.
2. The administrator verified they do not have documentation of child 5's physical examination.
Plan of Correction: Documentation of child 5's physical examination will be obtained from the parent/guardian within five days or the child will not be allowed to return until the documentation has been received.
Standard #: 22VAC40-185-510-J Description: Based on observation, the center failed to keep medication in a locked place to prevent access by children. Evidence: In the school age classroom, an Epipen was in a clear plastic container with a lid on it in a cabinet above the sink. The cabinet was left unlocked. Plan of Correction: All staff will be reminded to keep the cabinets locked.
Standard #: 22VAC40-185-520-A Description: Based on observation and record review, the center failed to use sunscreen in accordance with the manufacturer's recommendations. Evidence: 1. A sunscreen labeled for use by child 6 is stamped by the manufacturer as expired on 3/2018. 2. Documentation of use shows the sunscreen was last used on child 6 7/10/18. Plan of Correction: The sunscreen will be disposed of. All staff will be advised to check the expiration date of sunscreen each time the sunscreen is used.
Standard #: 63.2-1720.1-A Description: Based on record review and interview, the administrator failed to ensure all new staff obtained a fingerprint background check prior to employment. Evidence: 1. The record for staff 4 documents the start date of employment as 5/21/18 and staff 5 as 5/29/18. Neither staff's records contain documentation of a fingerprint background check being completed. 2. Both staff 4 and staff 5 were working the date of the inspection. 3. The administrator stated she had not had staff 4 and staff 5 complete a fingerprint background check. Plan of Correction: Staff 4 and staff 5 will schedule an appointment for fingerprint background checks immediately. Copies of the appointment verification will be forwarded to the licensing inspector.
