- Technical Assistance:
Discussed with center management that the written record of a child's serious injury documented a different account of the circumstance of the injury than the interview account provided by staff. Also discussed entry for action to prevent recurrence.
An unannounced inspection was conducted on 7/16/18 from 2:10pm to 3:45pm to investigate a complaint received on 7/12/18 relating to a child sustaining injuries to three fingers of his left hand when a wooden toy shelf fell on his hand. Staff interviews were conducted. Staff and children's records were reviewed. Injury reports were also reviewed. Based on the preponderance of evidence, the complaint is determined to be valid. Standard #: 22VAC40-185-270-A Complaint related: Yes Description: Based on observation, equipment inside the center was not maintained in a safe and operable condition. Evidence: 1. On 7/12/18 at approximately 5:40pm, Child # 2 pushed over a wooden toy shelf approximately three feet long and two feet tall. The shelf landed on the left hand of Child # 1 (19 months). At the time of the incident the shelf was standing on the floor in the middle of the room. Staff # 1 stated that the shelf was empty when it fell. 2. During the investigation, it was observed that the edges of the toy shelf base were rounded. When the toy shelf was touched by the inspector it wobbled and was unstable when standing by itself on the flat floor surface. 3. Staff # 1 stated that the shelf was empty when it was pushed over. Plan of Correction: Maintenance repaired/realigned wobbling shelves.
Standard #: 22VAC40-185-340-A Complaint related: Yes Description: Based on record reviews, staff interviews and photographic evidence, staff supervising children did not always ensure their protection. Evidence: 1. On 7/12/18, at approximately 5:40pm, Child # 2 pushed over a wooden toy shelf approximately three feet long and two feet tall. When the shelf fell, it landed on the left hand of Child # 1 (age 19 months), seriously injuring three fingers. 2. Staff # 1 stated that before the injury occurred, Child # 2 had just pushed the same shelf over and it had fallen on the floor and that Staff # 1 picked up the shelf after it fell. 3. Staff # 1 stated that within seconds of standing the shelf in an upright position, Child # 2 pushed the shelf over again. Child #1 was on the floor in front of the shelf and when the shelf fell to the floor, it landed on Child # 1's left hand. 4. Staff # 1 stated that Child# 1's fingers began to swell immediately after the shelf fell on the child's hand. Staff # 1 stated that Child # 1 cried a lot at the time of injury. 5. The person authorized to pick up Child # 1 stated that when he arrived at the center to pick up at approximately 6:00 pm, Child # 1's fingers were swollen and Child # 1 was still crying. 5. The parent and medical records confirmed Child # 1 sustained multiple fractures of 3 fingers of the left hand. Two of the three fingers had displaced fractures that required surgery to re-align the bones. Plan of Correction: All staff were retrained on Hopkins House Supervision as well as Sight and Sound Policy. Staff were retrained on teacher positioning for optimal supervision on 7/26/18 and ongoing.
Standard #: 22VAC40-185-550-K Complaint related: Yes Description: Based on record reviews and staff interviews, the center did not notify the parent immediately when a child sustained a serious injury. Evidence: 1. Staff # 1 stated that on 7/12/18, at approximately 5:40pm, a wooden toy shelf approximately 2 feet tall and 3 feet long fell on the left hand of Child # 1 (19 months). Staff # 1 stated that Child # 1's fingers began to swell immediately and the child cried a lot. 2. Staff # 2 stated that the center did not notify Child # 1's parent of the injury on the date of the injury, 7/12/18. 3. Staff # 1 stated that the written report of the injury was provided to the parent on 7/13/18. Plan of Correction: At the time of visit all reports had been submitted to the parents. Staff will be retrained to ensure a center copy will remain in the center at all times. All reports are now available.
