22VAC40-185 STAFFING AND SUPERVISION.
Two unannounced inspections were conducted to investigate two self-reported incidents, both involving staff supervision. On 07/05/2018, the first inspection was initiated in response to a self reported incident that occurred on 07/03/2018. During the investigation another self reported incident occurred on 07/12/2018 and the investigation into the second incident was initiated on 07/16/2018. Based on staff interviews, written documentation and recordings from the center's own video system, violations were found regarding staff supervision, following the center's policies and procedures and building maintenance. Standard #: 22VAC40-185-40-E Description: Based on staff interviews and documentation review and center's own video recording system, staff failed to follow the center's own policies and procedures for identifying where children are at all times. Evidence: 7/3/2018 Incident: 1. The center's playground policy requires staff to walk around the playground to ensure proper supervision of all children. 2. The Center's recording shows Staff #1 was recorded standing in the corner with the gate of the fenced area on the toddler playground for approximately 25 minutes without moving around the playground as required by policy. 7/12/2018 Incident: 1. The center's Face to Name policy requires staff to compare the children's faces that they see in the classroom to the name listed on the Face To Name Transition and Attendance Sheet and document the exact time of the Face to Name attendance check and the transition code for the new location such as PG=playground. 2. On 7/12/2018, Staff #2 failed to complete the required Face to Name documentation as the children transitioned from their classroom to the playground on 07/12/2018. 3. Staff #2 left Child #3 (26 months) alone in the classroom for approximately 21 minutes until the child was found by a staff member who noticed the child alone in the classroom. Plan of Correction: 7/3/2018 1. A mandatory staff meeting was held on 7/18/2018, conducted by Rachel Strasberg, Principal and Elayne Garrett, Executive Director. Staff were trained at this meeting on playground safety, and proper ways to properly supervise the playground always. The members of the management team will monitor the playground several times a day and log it . 7/12/2018 1. At the staff meeting on 7/18/2018, the entire staff watched the video footage of the incident of the child left in the classroom for more than 20 minutes. The principal and executive director trained staff on name to face. All new staff will be trained on name to face moving forward. Each leadership team member will check name to face transitions three times daily. The staff watched the video of the child left unattended and the seriousness of the issue was stressed to each staff member at the meeting. Teachers who are in their classrooms alone will call manager to observe every transition name to face and sweep the classroom.
Standard #: 22VAC40-185-270-A Description: Based on observation and staff interviews, one area of the center was not maintained in an operable condition. Evidence: 1. The Licensing Inspector observed the broken gate during the inspection on 7/16/2018. 2. Staff confirmed that the gate leading from the toddler playground to the preschool playground had been broken since 6/29/2018. 3. On 07/03/2018, Child #1 (17months) and Child #2 ( 22 months) walked from the toddler playground through the unlocked gate and entered the preschool playground. Plan of Correction: The gate has been repaired. Any gates which break in the future will immediately be bungee tied together until a lock is installed.
Standard #: 22VAC40-185-340-A Description: Based on staff interviews, staff written statements and observation of the video recording by the center's own system, staff failed to ensure the care, protection and guidance of 3 children. Evidence: 7/3/2018 Incident: l. On 07/03/18, Staff #1 was on the toddler playground with 4 children. During this time, Child #1 (17 months) and Child #2 (22 months) left the toddler playground and entered the preschool playground unnoticed by Staff #1. 2. The Center's recording shows Staff #1 was recorded standing in the corner with the gate of the fenced area on the toddler playground for approximately 25 minutes without moving around the playground as required by policy. 3. The video recording shows Child #1 and Child #2 climbing on preschool equipment and standing on the platform of the equipment that had two openings with a four foot height drop. The equipment was located through a gate and around a corner from where Staff #1 was standing, a distance of approximately 70 feet. 4. On 07/03/2018, Staff #3 who was lining the intermediate classroom up to transition outside noticed Child #1 and Child #2 alone on the preschool playground and Staff #3 alerted administrative staff to the children. 07/12/2018 Incident: 1. On 07/12/2018, Staff #2 was lining children up to transition from the classroom to the outside playground, Child #3 (26 months) was recorded standing approximately 10 feet away from Staff #2 who exited the perimeter door leading to the outside playground leaving Child #3 behind in the Beginner's classroom. 2. Approximately 21 minutes later Child #3 was noticed in the Beginner's classroom by Staff #3 who was walking past the Beginner's classroom and saw Child #3 alone in classroom. 3. During the 21 minutes Child #3 was alone, the child was recorded standing on chairs to reach up to a cubby and obtain a water bottle. Child #3 was also recorded on numerous occasions looking out the classroom window for their class and attempting to exit out the perimeter door. Child #3 was recorded playing with a plastic shopping bag for approximately 4 minutes lifting it above their head on more than one occasion. Plan of Correction: 1. Staff will be trained at the mandatory staff meeting on 8/22/2018 to scan the classroom and restroom to ensure that all children are safely out of the classroom during any transition. The classroom will be scanned prior to closing the door of the classroom onto the playground or the hallway. Name to face will be done electronically and on paper. The training on 8/22/2018 will teach paper name to face. The training will be done by the executive director and the new principal. The training will emphasize the importance of safety for children
Standard #: 22VAC40-185-340-F Description: Based on a staff interviews, staff written statements and observation of the center's video recording system, children were not always within actual sight and sound supervision of staff.
l. On 07/03/18, Child #1 (17 months) and Child #2 (22 months) left the toddler playground and entered the preschool playground alone at approximately 10:31am and were not within sight and sound supervision of any staff for approximately four minutes. Management self reported the incident and is in agreement that both children were not within sight and sound supervision for approximately four minutes.
2. On 07/12/2018, Child #3 (26 months) was left alone in the Beginner's classroom at approximately 10:22am and was not within sight and sound supervision for approximately 21 minutes. Management self reported the incident and is in agreement that this child was not within sight and sound supervision for approximately 21 minutes.
Plan of Correction: 1. A mandatory staff meeting will be held on August 22, 2018. The principal and executive director will review supervision of children and the state of Virginia code The areas of 22VAC40_185-(5) -340 below will be covered. We will use the licensing regulations as our training tools. All relevant regulations will be covered from the code of Virginia
