22VAC40-191 Background Checks (22VAC40-191)

The licensing inspector conducted an unannounced renewal inspection from 9:45am - 2:45pm. There were forty children in care: four infants with two staff, nine toddlers with three staff, fifteen 2's and 3's with four staff, and twelve preschoolers with two staff. The director was also present. The children were observed having snacks, during circle time, playing on the playground, and during lunch. Five staff's records and five children's records were reviewed. Areas of non-compliance are identified on the violation notice. Standard #: 22VAC40-185-330-B
Description: Based on observation, the center failed to have resilient surfacing underneath and surrounding climbing equipment. Evidence: 1. The inspector observed the infant/toddler playground. The center had placed three climbers with slides on the playground; however, the playground has no resilient surfacing. The fall height of the equipment is 18 inches.

Plan of Correction: The director will remove the climbers from the infant/toddler playground today.

Standard #: 22VAC40-185-500-A
Description: Based on observation, the center failed to have children wash their hands before and after snacks. Evidence: 1. The inspector observed the toddler class during snack time. The children were not observed washing their hands before or after eating snacks.

Plan of Correction: The director will discuss hand washing with the toddler staff. The director will monitor to ensure the children wash their hands before and after snacks and meals.

Standard #: 22VAC40-185-510-J
Description: Based on observation, the center failed to have all medication stored in a locked place. Evidence: 1. The inspector observed the center. There was a container of gas drops in an unlocked cabinet drawer. The cabinet is located in the hallway outside the infant and toddler classrooms.

Plan of Correction: The director removed the gas drops from the cabinet drawer during the inspection. The director will return the gas drops to the child's parent today. The medication has not being administered.

Standard #: 22VAC40-191-40-D-1-B
Description: Based on record reviews, the center failed to obtain background checks for staff within 30 days of employment. Evidence: 1. The inspector reviewed five staff's records. Two of five records reviewed (staff record #2 and staff record #3) did not contain searches of the central registry checks and staff have been employed for more than 30 days. Staff #2's date of employment is 05/24/2018 and staff #3's date of employment is 05/17/2018.

Plan of Correction: The director has submitted requests for the searches of the central registry checks for both staff, but they have not been returned. The director will call the office of background investigations and ask about these requests. The licensing office will be notified when the checks are returned.
