22VAC40-191 Background Checks (22VAC40-191)

An unannounced monitoring inspection was completed September 17, 2018 from approximately 12:45p.m. to 3:30p.m. Seventeen children were in care during the inspection. Staff and children were observed engaging in activities to include transition to lunch, hand washing, eating lunch and nap time. The children, infant to four years old, were observed in three classrooms with adequate staff ratios. Children?s equipment, learning materials, outdoor and classroom space, bathrooms and the center?s first aid, emergency supplies were inspected. Five children?s records, five staff records, annual fire and health inspections, fire drill, shelter in place and lock down logs, daily attendance and required postings were reviewed. The center does not provide transportation or administer medication and there were no injury reports to review. The Director was available for interview and inspection and was present at the exit interview at which time inspection findings were reviewed and an Acknowledgement of Inspection form was signed and left with the licensee. There were four citations for violations of the Standards for Child Day Centers. See the violation notice on the Department?s public web site for violations of the Standards.

Standard #: 22VAC40-185-70-A
Description: Based on a review of staff records and interview, the licensee failed to maintain all the elements of staff?s records for one of five staff. Evidence: 1. Staff #3 was hired on April 25, 2018 as a lead teacher. 2. Staff #3's record lacked written information to demonstrate that Staff #3 possessed the education/training and/or experience required by the job position. 3. In an interview, Administrator #1 reported that Staff #3 was a previous child care center director and therefore possessed the qualifications for the job position. However, Administrator #1 acknowledged Staff #3's education/training and/or experience demonstrating possession of the required qualifications was not documented.

Plan of Correction: The owner/director will obtain documentation of staff's education/triaining and/or experience demonstrating staff possesses the required qualifications.

Standard #: 22VAC40-185-210-A
Description: Based on review of staff records and observation, the licensee failed to ensure that a staff possessed all the required qualifications for a program leader for one of five staff.
Evidence: 1. Staff # 1 was hired on May 11, 2016 as a substitute teacher. 2. During the inspection Staff #1 was observed as the lead teacher in the three to four year old classroom. 3. Staff #1?s record lacked documentation that Staff #1 possessed the required education/experience and/or training to be a program leader. 4. Administrator #1 indicated that Staff #1 only works as as substitute teacher and acknowledged that Staff #1 does not possess the required qualifications to be a lead teacher.

Plan of Correction: Owner/director will no longer utilize this staff as as substitute until staff meets the qulifications.

Standard #: 22VAC40-185-240-C
Description: Based on a review of staff records, the licensee failed to ensure staff obtained 16 clock hours of annual training for one of five staff. Evidence: 1. Staff #1 was hired on May 11, 2016 as a substitute teacher 2. Staff #1?s record reflected approximately eight hours of annual training since hire. 3. Administrator #1 acknowledged Staff #1 has not completed the required amount of annual training.

Plan of Correction: Owner/director will ensure that staff have the required amount of annual triaining.

Standard #: 22VAC40-185-430-C
Description: Based on observation of the playground, the licensee failed to ensure that S-hooks where provided are not open more than the thickness of a penny. Evidence: 1. Three swings were observed on the playground, each hung using S-hooks. The S-hooks were observed to be wider than a penny?s thickness. 1. Administrator #1 reported the swing set was recently purchased and acknowledged the S-hooks were open more than a penny?s thickness.

Plan of Correction: Owner/director will will close the S-hooks to the correct thickness.
