Comments:
The licensing inspector conducted an unannounced inspection on 09/26/18 in response to a self report received in the licensing office on 09/21/18 regarding allegations in the area of supervision. Interviews were conducted with staff , records were reviewed and observations of the program were made relating to the allegation. The information gathered during the investigation supports the allegations, so the complaint is determined to be VALID

Violations:
Standard #: 22VAC40-185-340-A
Description: Based on a record review, interviews and observations made of the program the center did not ensure the care, protection and guidance of the children when staff are supervising them. Evidence: 1. On 09/21/18 a 3 year-old (child #1) was left on the playground and was not in sight and sound supervision of staff sometime between 4:00 pm - 4:07 pm. 2. Child #1 was discovered after staff heard knocking at the back door of the three year-old classroom. Staff #2 reported he also heard a child crying. Staff #2 opened the back door to discover Child #1 had been left outside on the playground. 3. Based on a record review and interviews Staff #1, #2 and #3 who were supervising the children that day were teacher assistants. Staff #1 and #2 stated they did not know who the program leader was in the room. The director confirmed no one had been appointed as the program leader. 4. According to interviews and a record review staff did not report the incident to the Director. During interviews staff stated they did not report the incident because the child had been found. 5. According to interviews with the district manager and director, a collateral witness called the center's corporate office and reported seeing child #1 on the playground alone and knocking at the back door of the classroom until staff opened the door to let the child in.

Plan of Correction: The following corrective action was provided by the Director during the exit interview: All three staff were written-up with suspension, and required to take training through CCEI. Staff #1 is no longer working at the center. The Director spoke to all staff about how important supervision is. This was the director's second week in her new role and was still in the process of assessing the center and correcting any previous concerns.

Standard #: 22VAC40-185-340-F
Description: Based on a record review, interviews and observations made of the program the center did not ensure children under 10 years of age were always within actual sight and sound supervision of staff. Evidence: On 09/21/18 child #1, a 3 year-old was left on the playground and was not in sight and sound supervision of staff sometime between 4:00 pm - 4:07 pm. 1. At about 4:00 pm Staff #1, #2 and #3 were outside on the playground with 18 three year-old children. 2. As the children were lining up to come inside, Staff #1 went back into the building, leaving Staff #2 and #3 with the children. 3. Before leaving the playground area, Staff #2 did a head count with the children and lined-up against the wall closest to the equipment. 4. As Staff #2 and #3 were walking toward the classroom's back door two children ran from the group. Staff #3 ran to retrieve the two children and took them inside the building. 5. At that time Staff #2 had taken the rest of the children inside the building. 6. Staff confirmed a head count was not completed upon returning to the classroom. 7. Around 4:07 pm all three staff reported they heard a knock at the back door. Staff #2 opened the back door to discover Child #1 had been left outside on the playground.

Plan of Correction: The following corrective action was provided by the Director during the exit interview: All three staff were written-up with suspension, and required to take training through CCEI. Staff #1 is no longer working at the center. The Director spoke to all staff about how important supervision is. There is now a permanent program leader in the three year-old classroom. All staff have been retrained on their roles and job descriptions. This was the director's second week in her new role and was still in the process of assessing the center and correcting any previous concerns.

Standard #: 22VAC40-191-60-C-2
Description: Based on a record review the center did not ensure all background check requirements were met. Staff #1 (doh 03/21/16) did not have documentation of a central registry finding within 30 days of employment.

Plan of Correction: The following corrective action was provided by the Director during the exit interview: Staff #1 was sent home. The Director sent for her background checks. The check returned, however the staff never returned back to work.
