22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitoring inspection was completed on 10/09/2018. There were 19 children, ages 3 years-11 years, 4 staff providing direct care and supervision, and the Compliance Officer present during today's inspection. The inspector reviewed 5 children's records and 4 staff records during the inspection. There is currently no medication being administered at the program. The children were observed in the following activities: during rest time, watching learning videos, during the transition from the school day to the after school program, during homework time, during free choice activities and during afternoon snack. The inspector reviewed the emergency procedures and emergency supplies during the inspection today. The inspector discussed the following with the site staff: background check requirements, sharing space with the school, the new classrooms being used by the preschool-aged children, staff documentation and emergency drills. Standard #: 22VAC40-185-60-A Description: Based on record review and discussion with the staff, the facility failed to ensure that children's records contain all components as required by the standards. Evidence: The record for Child #3 did not contain documentation of viewing proof of the child's identity and age. Child #3 was in care during the inspection. Plan of Correction: The Compliance Officer will call the parent and get the missing information.
Standard #: 22VAC40-185-240-C Description: Based on record review and discussion with the staff, the facility failed to ensure that staff who work directly with children shall annually attend 16 hour of staff development activities that shall be related to child safety and development and function of the center. Evidence: Staff #2 only had 11 annual training hours for the 2017-2018 school year. Plan of Correction: The Compliance Officer will make sure that all staff get the required training hours each year.
Standard #: 63.2-1720.1-B-2 Description: Based on record review and discussion with the staff, the facility failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint criminal record check as required by the Code of Virginia. Evidence: The record for Staff #4 has a documented hire date of 08/08/2018; the fingerprint eligibility letter is dated 09/07/2018. Plan of Correction: No one will be hired without the eligibility letter.
