63.2 Child Abuse and Neglect

Comments:
The Licensing Inspector conducted an investigation in response to a self report incident that was reported on October 1, 2018 of inappropriate handling of a child which occurred on September 26, 2018. Joint interviews with another public agency were conducted with staff on October 2, 2018. The information gathered during this investigation supports the allegations; violations were discussed with the acting center director and owner. Violations:
Standard #: 22VAC40-185-400-B
Description: Based on staff interviews, a staff member failed to provide behavioral guidance that is constructive in nature, age and stage appropriate and intended to redirect the child to appropriate behavior and resolve conflicts. Evidence: 1. On Wednesday, September 26, 2018, Staff #1 and Staff #5 were with a group of 4 year old children on the playground when Child #1 slapped another child in the face. Staff # 1 stated that she observed Staff #5 gather the children and put Child #1 (4 years old) in the middle of the circle to play Ring Around the Rosie. Staff #5 instructed all the children to fall on the child, and then said to the child, ?That?s what you get. How does it feel when others hurt you?? 2. Staff #3 stated that on Friday, September 28, 2018, Staff #5 told Staff #3 that she ?messed up? by putting a child in the middle of a circle to play Ring Around the Rosie, and instructing all the children to fall on the child. Staff #5 said she then told the child ?That?s what you get?. 3. Staff #5 stated that on September 26, 2018, she was told that Child #1 had slapped another child in the face. Staff #5 said she gathered the children in a circle to play Ring Around the Rosie, put Child #1 in the middle, and instructed all the children to fall on the child. Staff # 5 then said to the child, ?This is how you feel when you get pushed?.

Plan of Correction: All staff involved in the incident were terminated immediately. All staff will receive additional training in recognizing child abuse and neglect and dealing with behavioral issues.

Description: Based on staff interviews, the center failed to ensure that staff did not engage in forbidden actions of punishment by another child.
Evidence:
1. On Wednesday, September 26, 2018, Staff #1 and Staff #5 were with a group of 4 year old children on the playground when Child #1 slapped another child in the face. Staff # 1 stated that she observed Staff #5 gather the children and put Child #1 (4 years old) in the middle of the circle to play Ring Around the Rosie. Staff #5 instructed all the children to fall on the child, and then said to the child, ?That?s what you get. How does it feel when others hurt you??
