Summary:
A complaint was investigated at the facility on 10/15/2018 in response to a complaint received by the Department on 10/10/2018. Investigation included observation, staff interviews and interview with a grouping of children.
The complaint alleged that the staff roughly handle children. A preponderance of evidence gathered through observation and staff and children interviews did not support this allegation, thus it is determined to be not valid.
Also alleged was that staff use inappropriate discipline techniques when guiding children. Observation revealed this allegation to be valid.

Description: Based upon review of three staff records and staff interview, the facility has not ensured that each staff record contains documentation that two or more references as to character and reputation as well as competency were checked before employment. Evidence: 1. The record provided for staff 4 indicated a date of employment of 10/8/2018. The record included documentation of only one reference check. 2. Staff 1 verified that only one reference was documented in the record provided for staff 4.

Plan of Correction: The facility responded with the following:
Moving forward, the Director will ensure that all references will be documented prior to the first day of employment.

Description: Based upon observation, the facility has not ensured that in order to promote each child's physical, intellectual, emotional and social well-being, staff interact with the children to provide needed help, comfort and support, encouraging decision-making abilities, independence and self-direction.
.Evidence:
Staff 5 was observed overseeing a group of 9 children, aged three years through five years.
Because of their disruptive behavior, children 1, 2 and 3 were made to sit in chairs at a table without activities from 11:50 AM - 11:56 AM while the remainder of the group were engaged in an activity. At 11:56 AM, staff 5 used physical contact to move child 2 from her chair to join the group by holding her by the upper right arm. At 11:57 AM, child 3 was also moved from her chair to join the group activity by holding her by the right arm. Child 1 was also moved to his place in the group by holding his left arm.

Plan of Correction: The facility responded with the following:
Moving forward, the Center will ensure that children are always given activities regardless of the circumstances. The Center will also ensure that children are held by their hands instead of their arms.
