Comments:
The licensing inspector conducted an unannounced inspection on Wednesday, October 17, 2018 from 2:45pm to 3:10pm and on Monday, October 29, 2018 from 2:50pm to 3:35pm in response to a self-reported incident that the Department received on October 10, 2018. Interviews with staff were completed, observations were made at the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation supports areas of noncompliance with the licensing standards related to the care and guidance of children. See the violation notice for more details. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the Violation Notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Violations:
Standard #: 22VAC40-185-340-A
Description: Based on documentation review and interviews, the center did not ensure that when staff are supervising children, they shall always ensure their care and guidance. Evidence: 1) Documentation reviewed states "...[Staff #2] said she had to use the restroom badly and could not find anyone to take the one child that would put them out of ratio for one teacher. She could wait no longer so she took the child [Child #1, 2-year-old] with her and turned her facing away from the toilet and gave her toilet paper to play and stack. [Staff #2] was trained by me on how to use the phone to contact admin and other rooms. She was also trained not to take a child into the restroom." 2) Staff #1 and Staff #2 were supervising a group of nine children (2-years-old) on 10/09/2018. During interview on 10/29/2018, Staff #2 stated that in the afternoon of 10/09/2018, she took Child #1 to the staff restroom for approximately 2 to 3 minutes. Staff #2 stated that she could not find anyone to step in or take the child so as to not cause Staff #1 to be out of ratio by one child. Staff #2 taking a two-year old child into the staff restroom with her, and using the restroom with the child present in the restroom did not demonstrate appropriate care and guidance.

Plan of Correction: Per the Director: Teacher was trained on how to work the phone system to contact admin and other classrooms for assistance. Teacher was also given formal one-on-one coaching on proper supervision of children that was placed in her permanent file.
