The licensing inspector completed an inspection in response to a self-reported concern regarding the care and protection of a child in care that occurred at the center on 11/14/2018. The Department was notified of the incident on 11/15/2018. On 11/15/2018, the licensing inspector was on site from approximately 1:00 PM until 4:15 PM. During the inspection, interviews with staff were completed, observations were made and documentation was reviewed. The preponderance of the evidence gathered during the investigation supports areas of noncompliance with the licensing standards related to the care and protection of children in care.

Standard #: 22VAC40-185-340-A
Description: Based on interviews and review of documentation, staff did not ensure the care and protection of a child in care with a known food allergy. Evidence: On 11/15/18, the licensing inspector interviewed six staff members and reviewed documentation and the following was determined to have occurred on 11/14/18: 1. Child A (3 years of age) has an emergency care plan for a peanut and tree nuts allergy completed by a physician and parent, and emergency medication present at the center. The Food Allergy & Anaphylaxis Emergency Care Plan stated to give epinephrine immediately if the allergen was definitely eaten even if no symptoms are apparent. The allergy list in the kitchen, dining car and staff binders documented the peanut and tree nuts allergy for Child A. 2. Staff #1 stated he placed three different types of muffins in the dining car for morning snack. Staff #1 stated the muffins were an assorted pack including blueberry, apple cinnamon and what he believed to be a bran muffin. 3. Staff #2 stated at approximately 8:45 AM, the Blue Room went to the dining car to eat morning snack. Staff #2 stated the children in the Blue Room began to eat the muffins that were labeled for their classroom. Staff #2 stated she also believed the muffins were a bran muffin because they were brown and had oats on the top. Staff #2 stated she bit into the muffin and thought she had tasted a nut and then she broke open the muffin and saw nuts in it. Staff #2 stated she told Staff #3 there were nuts in the muffin and Staff #2 and Staff #3 immediately went over to Child A and saw Child A had eaten at least half of the muffin. 4. Child A was taken to Get Well, where Staff #4 called the parent of Child A and informed the parent that Child A had ingested a muffin that contained nuts. 5. The parent of Child A stated to the licensing inspector she instructed Staff #4 to hold off administering the emergency medication and observe Child A for symptoms due to recent instructions from the physician. 6. Staff stated Child A did not exhibit symptoms from consuming the nuts, emergency medication was not administered, and that Child A remained at the center until after 5:00 PM. 7. The five staff members stated they were aware Child A had a documented peanut and tree nut allergy. 8. Staff stated it was later determined that the muffins that were assumed to be oat bran muffins were actually banana nut muffins.

Plan of Correction: At the time of the incident, and prior to the inspectors visitation, the exposure was fully reviewed by the Administrative Team, including the Preschool Director, Director of Operations, Nurse Coordinator, and Owner. The nut based muffins were immediately removed. The chef was retrained on our school requirements of reading all ingredients prior to inventorying them for use in the school. Retraining consisted of two separate reviews of the school?s health and safety protocols with signed documentation. All retraining occurred between 11/14/2018 and 11/19/18. Furthermore, our food vendor was contacted on 11/14/18 and reminded that we do not serve nuts or products with any nut based ingredients at our school and items of this nature are never to be ordered/delivered to our facility. This was previously in place, however the incorrect muffin was ordered and delivered. Incident was reviewed with all school personnel on 11/14/2018. Additionally, all school personnel were reminded of food service and safety protocols via email on 11/14/2018. School administration to monitor for continued compliance. All corrective actions are complete at this time.
