22VAC40-185 STAFFING AND SUPERVISION.
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 03/06/2019. Interviews were conducted with staff, and observations and inspections made relating to allegations that ratios were not being met. The evidence gathered during the investigation supports allegations, so the complaint is determined to be valid. Please contact me if you need further assistance. Thank you.
Standard #: 22VAC40-185-70-A Complaint related: No Description: Based on review of documentation and discussions with administrative staff the facility failed to maintain compliance with this standard as required relating to staff files. Evidence: Staff #1, hire date 03/04/2019, did not have a file available for review during this complaint inspection. The staff was actively working at the center; and was counted in ratio in the preschool building today 3-11-19. Administrative staff #4 ad #5 arrived at the center at 10:05am with 2 other new staff files, #2 and #3, but not one for staff #1. Plan of Correction: The RD will let HR know that staff must have a file on site before working at that location. 3/25/2019
Standard #: 22VAC40-185-270-A Complaint related: No Description: Based on observations and discussions with staff the facility failed to maintain compliance with this standard as required relating to equipment of the center. Evidence: The land line phone system (in the upper building) was not properly working during this complaint investigation. The phones would not ring to alert that a call was coming in to the center. The only way to know was to be sitting near the phone and see the screen light up alerting of an incoming call. In the preschool building (lower building) there was a table standing on its side leaned up against the wall in the kitchen/schooler area. The children were sitting in the area near the table. This propped up table created a fall hazard, and could injure the children. Plan of Correction: The phones are up and running now and Management suggested using a cell phone the next time this happens to ensure that we have a way for parents to reach the center. 3/22/2019 The PD will remind staff to not prop tables in the classrooms. 3/26/2019
Standard #: 22VAC40-185-290-3 Complaint related: No Description: Based on observations and discussions with staff the facility failed to maintain compliance with this standard as required relating to covering of electrical outlets. Evidence: In the lower building (preschool and schooler) there were 4 separate outlets throughout the center that did not have the protective covers in place as required. Plan of Correction: The PD will ensure that staff know to make sure that they have all outlets covered and that there are extra in the licensing tote in the office if needed. 3/26/2019
Standard #: 22VAC40-185-340-A Complaint related: No Description: Based on observation and disclosure of staff the facility failed to maintain compliance with this standard as required relating to the care of the children. Evidence: At 10:05am 2 administrative staff (#4 and #5) arrived at the center, sharing the car of staff member #5. Upon discussions it was revealed that staff #4 had a fever of 101 degrees,had taken fever reducing medication prior to arriving at the center, and had come to help and answer any questions. Staff #4 placed the children at risk by coming to the center while having a fever. Plan of Correction: HR will discuss with the RD not to come into the center with a fever of 101 or higher to work. 3/26/2019
Standard #: 22VAC40-185-350-C Complaint related: Yes Description: Based on observations and discussions with staff the facility failed to maintain compliance with this standard as required relating to ratios. Evidence: On 3/11/19 from 8:20am-8:35am there were 18 children aged 2yr-3yr with 2 staff. The required ratio at this time was 1 staff to 8 children. On 3/11/19 from 8:25am-8:40am there were 6 children aged 13months-23months in care with 1 staff. One child in care was special needs and not mobile. The required ratio at this time was 1 staff to 4 children. Staff stated during interviews: 1. On several occasions they have had to work over ratio for longer than the morning hours, due to call outs and lack of available staff. 2. Administrative staff of the center were constantly in the classrooms working to ensure that ratios were being met at any given time, usually working all day on most instances. 3. Administrative staff would make the decision to work over ratio in the room (when there were no other staff available to assist them, so that other staff/classrooms would not have to work/be over ratio. 4. Staff sated that ratios had been hard to maintain and are not maintained in numerous classes from approximately 7am-9am daily for at least 2 months now. 5. The chaos witnessed by LI was the what each morning looks like, with moving children to make ratio and some rooms just out of ratio until more staff come in, or are sent from the sub pool/cooperate to help; if any are available or sent. Plan of Correction: The RD, PD working with HR to ensure that they have a plan in place to hire staff to meet the needs of the center so that they are in ratio. They will look at adjusting staff schedules to fix morning/after-noon ratios and will use subs to meet the standards. 3/25/2019
Standard #: 22VAC40-185-350-F Complaint related: No Description: Based on interviews with staff and administrative staff the facility failed to maintain compliance with this standard as required relating to moving of children from classroom to classroom. Evidence: Staff interviews and LI observation found that children are repeatedly moved to help maintain compliance with required ratios on most mornings during the week for the last 2 months. Children were actively being moved from class to class for ratio purposes while the LI was present today. Children were being moved from one infant room to another, from the infant room to the toddler room, and from the toddler room to the 2/3 year old room. Staff verified that this is what occurs each morning from approximately 7am-9am. Staff stated that this has to occur since the center has at least 6 staff positions needing to be filled. The LI witnessed several parents complain/state to the staff that they "wished that their child did not have to be moved every morning, and having to ask which room do I need to drop them off in this morning". Plan of Correction: Staff have been filled for open positions and head counts will be taken during the early morning to see if any staff schedules need to be addressed. 3/25/2019
