Comments:
A complaint was received on March 4, 2019 and an investigation was initiated on the same day regarding a two year who sustained a head injury while in care. During the investigation children and staff records were reviewed. A walking tour of the classroom was conducted, the equipment/toys involved in the injury were reviewed, staff and parent interviews were conducted on site and via telephone and photographs of the injury were viewed. The information gathered during the investigation, which concluded on March 20, 2019, supports the allegation and the complaint is determined to be valid. Additionally, violations not reported as a part of the complaint were found during the investigation. All violations appear on the violation notice including: children?s records, staff records and supervision. Violations were reviewed with the program director during the exit interview at the conclusion of the onsite inspection.

Description: Based on record review and interview the center failed to ensure that each child has a physical examination by or under the direction of a physician within one month after attendance. Evidence: 1 - The record for child 1 does not contain documentation of a physical examination. a. Child 1 has a documented first date of attendance of 3/9/18. 2 - Staff 1 confirmed that there is no documentation of a completed physical examination in the file for child 1.

Plan of Correction: Parent of child 1 was notified on 3-06-19 by management that child was in need of physician exam. Parent informed center that exam will be available to center within a few days

Description: Based on record review and interview the center failed to ensure that staff records contain all required information. Evidence: 1 - The record for staff 2 does not contain documentation of any reference checks. a. Staff 2 has a documented date of hire, as a teacher assistant, on February 28, 2019. 2 - Staff 1 confirmed that there are not any references on file for staff 2.

Plan of Correction: New staff hired will have reference checks recorded upon being hired .

Description: Based on interview and observation the center failed to ensure that when staff are supervising children they will always ensure their care, protection and guidance. Evidence: On February 28, 2019, child 1 sustained visible injury to his head while in care in the two year old classroom with staff 2 and 3 present. There were nine children present in the two year old classroom at the time of the incident. Photographs provided during the investigation depict two raised areas and a cut on the child's head. 1 - Staff 2 reported that she did not see what lead to child 1's injury. She was sitting on the floor, on the other side of the classroom from where child 1 was sitting on the floor, in the classroom. Staff 2?s attention was occupied with the other children in room making foot prints as a part of a craft activity when she heard child 1 scream. When she looked over she saw blood on his head. 2 - Staff 3 stated that she did not see how child 1 was injured. She was standing on the other side of the classroom engaged in an activity when she looked over and saw child 2 pulling his hand back away from child 1's head. Child 1 began to cry and was bleeding from his head. Child 2 had a "duplo" block in the hand he was pulling away from child 1's head.

Plan of Correction: 1. Management has talked to staff about separation in the classrooms to insure safety and supervision of the children. 2. Management checked and removed toys deemed unsafe for classroom

Description: Based on record review and interviews the center failed to ensure that in each grouping of children at least one staff member who meets the qualification of program leader or program director will be regularly present. Evidence: 1 - On February 28, 2019 there was not a program leader or program director qualified staff member present in the two year old classroom when child 1 sustained a head injury. 2 - Staff 1 stated that she was not present in the classroom when the incident occurred which lead to child 1 being injured because she had an appointment outside the center. However, staff 1 stated that she was the program director qualified staff that was assigned to the two year old room on February 28, 2019 at the time of the incident. 3 - Staff 2 and 3 stated that they were teacher assistants in the classroom and not in charge of the two year old classroom. a. Staff 2 stated that she was "just the assistant" and not the lead the teacher or in charge of the two year old classroom when child 1 was injured. b. Staff 3 stated that she hired as an assistant and did not know who the lead teacher was of the two year old class. Additionally, staff 3 stated that the day of the incident was her first day of employment. 4 - The documented job title in the records of staff 2 and 3 state that they were hired as teacher assistants. a. Staff 1 confirmed that staff 2 and 3 were hired as teacher assistants and that is the position they were working in at the time of the incident that lead to child 1's injury.

Plan of Correction: Management will make sure there is a qualified teacher in classroom at all times.
