63.2 Child Abuse & Neglect

Comments:
An unannounced investigation was initiated with another local agency 01/08/2019 in response to a self- reported incident that occurred on 01/07/2019 regarding supervision. During the investigation, staff were interviewed, staff and children's files were reviewed, center's video recordings were viewed and classrooms as well as hallways of the facility were observed. The preponderance of evidence supports the reported incident and violations were cited. A violation not related to the reported incident was also found. Please see violation notice for details. Findings were reviewed by phone with administrator on 03/07/2019.The exit interview was conducted in the licensing office with the administrators on 04/04/2019. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on staff interviews and review of the center's video recording and written policies and procedures, the operational responsibilities of the licensee did not ensure that the center's services were maintained in compliance with these standards, and the center's own policies and procedures required by these standards. Evidence: 1. According to the Campagna Center's "Positive Child Guidance Policy," page 43, under Guideline/Procedures, it states: "Staff will never use physical punishment, including but not limited to . . . arm twisting, . . . or grabbing by the arm or forearm." 2. On 01/07/2019 at approximately 12:12pm, Child A (3 years of age) was grabbed by the right arm, lifted off the floor, and dragged down a hallway by Staff A. 3. This incident was captured on a video recording with a time stamp of approximately12:12pm. 4. Staff A confirmed that she grabbed Child A during the 01/07/2019 incident.

Plan of Correction: 1. Management will facilitate retraining on the Positive Guidance Policy with all staff members 2. Management will facilitate a retraining on Mandated Reporting 3. Staff A was disciplined accordingly based on policy

Description: Based on record review, staff files were incomplete. Evidence: 1) Staff A did not have an emergency contact information on file. 2) Staff C did not have documentation of orientation training on file.

Plan of Correction: I will get her to fill one out when she comes back to work.

Standard #: 22VAC40-185-340-A
Description: Based on staff interviews and review of the center's video recording and written documentation, staff supervising children did not always ensure their care and protection. Evidence: 1. On 1/7/2019 at approximately 12:10pm, Child A (3 years of age) left the classroom (Room #113), and ran down the hallway. Staff B and Staff C, the Staff responsible for this classroom, confirmed during an interview conducted on 01/08/2019, that neither had realized Child A had left the room and was unsupervised. 2. On 01/07/2019 at approximately 12:12pm, Child A (3 years of age) was grabbed by the right arm, lifted off the floor, and dragged down a hallway by Staff A. 3. At approximately 12:12pm the center's video recording showed Staff A forcibly grabbing Child A and dragging him down the hallway of the facility. The body of Child A was twisting and turning as Staff A dragged the child by the arm, leaving the feet of Child A dangling in the air with moments of the knees touching the floor. Child A was dragged by Staff A up to a distance of approximately 40 feet. 4. Staff A confirmed within a written Child Accident/Injury/Incident Occurrence Report - dated 01/07/2019, that on January 7, 2019, at approximately 12:12 pm, Staff A ran after Child A until caught, to then take Child A to Staff E who was in another room. 5. Staff A confirmed, during an interview conducted on 01/16/2019, that she had grabbed Child A.

Plan of Correction: 1. Management will facilitate retraining on the Positive Guidance Policy with all staff members 2. Continue to use Face-to Name sheets during all transitions outside of the classroom to ensure that all children are always within sight and sound 3. Maintain accurate headcount at all times using the Face-to-Name sheet

Standard #: 22VAC40-185-340-F
Description: Based on review of the center's video recording and interviews with staff, a child under 10 years of age was not always within sight and sound supervision of staff. Evidence: 1. On 01/07/2019, at approximately 12:10pm, Child A (3 years old) left the classroom (Room #113) and entered the hallway. Child A went unnoticed by both Staff B (who was helping children from this same classroom out in the hallway at their lockers) and Staff C (who remained in the classroom with the rest of the children). Child A proceeded to run down the hallway to the left of the classroom and turned the corner, out of both sight and sound supervision of Staff B and Staff C. The hallway that Child A ran down was approximately 60 feet long. 2. Staff B, and Staff C confirmed, during an interview conducted on 01/08/2019, that neither had realized that Child A had left the room and was unsupervised. 3. This incident was captured in a recording which confirmed when the child left the room and that he was unsupervised for approximately for 1 minute, until Staff A intervened.

Plan of Correction: 1. Continue to conduct Face-to-Name checks during all transitions outside of the classroom to ensure that all children are always within sight and sound 2. Maintain accurate headcount at all times using the Face-to-Name sheet 3. Installed safety locks in all classrooms so that children cannot leave unnoticed

Standard #: 22VAC40-185-410-1
Description: Based on review of the center's video recording and interviews with staff, a staff person used a forbidden action of roughly handling a child. Evidence: 1. On 01/07/2019, at approximately 12:12pm, Child A (3 years of age) was forcibly grabbed by the right arm, lifted off the floor, and dragged down a hallway by Staff A. 2. This incident was captured on a video recording, with a time stamp of approximately 12:12pm. The video showed Staff A forcibly grabbing Child A and dragging him down the hallway of the facility. The body of Child A was twisting and turning as Staff A dragged the child by the arm; leaving the feet of Child A dangling in the air with moments of the knees touching the floor. Child A was dragged by Staff A up to a distance of approximately 40 feet. 3. Staff A stated, during an interview conducted on 01/16/2019, that she knew that staff "are not supposed to grab kids . . . I was feeling that I was scared that I may have broke his hand."

Plan of Correction: 1. Staff will receive retraining on Campagna Center Positive Guidance Policy 2. Staff will receive retraining on Forbidden Actions as it pertains to VDSS licensing standards 3. Additional training will be provided for key on site staff on proper/safe restraining techniques 4. Retraining will be provided on Mandated Reporting 5. Staff A was disciplined accordingly based on policy
