Comments:
The licensing inspector conducted an unannounced inspection on 03/22/2019, in response to a self-reported incident that the Department received on 03/14/2019 regarding forbidden actions. The inspector was on site at the center on 03/22/2019 from 08:50am to 11:12am. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. The inspector completed additional interviews on 04/16/2019 and 04/18/2019. The preponderance of the evidence gathered during the investigation validates the self-reported incident of forbidden actions. Violations were cited regarding forbidden actions and center policies. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on documentation review and interviews, the center did not maintain compliance with their own policies and procedures required by standards. Evidence: The center's policies and procedures regarding forbidden actions were not followed on March 13, 2019 when Staff #1 struck child #1 (2 years old), child #2 (2 years old), and child #3 (3 years old) on the leg for failing to comply with the instructions given by staff #1. The center?s policies and procedures for discipline states that "We do not at any time use corporal punishment for discipline," "You will be contacted at first measure of disciplining the child," and "Teachers are not allowed to use physical punishment, embarrassment or with hold [sic] food." These policies and procedures were not followed during the above described incident on March 13, 2019.

Plan of Correction: All employees will have training on stress management as well as child abuse. All of Kids-N-Us policies and procedures will be reinforced and reviewed. Termination for employee.

Standard #: 22VAC40-185-410-1
Description: Based on interviews and documentation review, the center failed to ensure the forbidden action of striking a child did not occur. Evidence: The licensing inspector conducted two staff interviews, and reviewed documentation on 03/22/19. The following statements were made regarding an incident that occurred on 03/13/19: Staff #1 wrote a written statement on 03/13/2019. Staff #1 stated "I, [staff #1], let stress get the better of me and warp my judgement into thinking I should pop the children when that should have not been the case. After telling them several times to sit down, I popped [child #1], [child #3], and [child #2] on the leg when they failed to comply." Staff #3 stated that staff #1 went into the office and informed them that they "popped" child #1, child #2, and child #3 one time on the leg. Staff #3 then immediately went to check the children and did not observe any injuries. Staff #3 stated that staff #2 was in the classroom at the time but did not see the incident. The inspector interviewed staff #2. Staff #2 revealed that they were in the girls bathroom assisting children and did not witness the incident .

Plan of Correction: Employee was suspended immediately pending investigation after investigation of 24hrs [the employee] was permanently terminated on March 14 and the training and review of policy and procedures took place April 6, 2019.
