Comments:
The licensing inspector conducted an unannounced inspection on 04/01/2019, in response to a self-reported incident that the Department received on 02/28/2019 regarding behavior guidance. The inspector was on site at the center on 04/01/2019 from 10:33am to 11:27am. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. The inspector completed additional interviews on 04/15/2019. The preponderance of the evidence gathered during the investigation validates the self-reported incident of inappropriate behavioral guidance. Violations were cited regarding behavior guidance and center policies. See the violation notice for more details. Please complete the ?plan of correction? and ?date to be corrected? for each violation listed on the violation notice and return it to me within 5 business days from receipt. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Standard #: 22VAC40-185-40-E
Description: Based on documentation review and interviews, the center did not maintain compliance with their own policies and procedures required by standards. Evidence: The center's policies and procedures regarding behavior guidance were not followed on February 28, 2019 when Teacher A raised their voice at child A several times, grabbed child A by the arm to pull the child off of the floor and held the face of child A on the jaw line as to restrict movement. The center?s policies and procedures for unacceptable child guidance states that "Certain discipline methods are simply not acceptable at KCE, including: Spanking, grabbing, pinching, or any physical punishment or restraint" and "Disrespectful communication such as yelling." These policies and procedures were not followed during the above described incident on February 28, 2019.

Plan of Correction: Staff will be retrained on proper behavior guidance policies.

Standard #: 22VAC40-185-400-B
Description: Based on review and interviews, the center did not ensure behavioral guidance was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts. Evidence: 1. During the 04/01/19 inspection, the following was determined: The center's representative reported that on 02/28/2019, "[Teacher A] grabbed [child A] by the arm to stop [child A] from turning on and off the lights, and then held [child A's] face on the jaw line to get [child A] to pay attention to [teacher A] as [teacher A] explained to [child A] what [child A] was doing wrong". "[Teacher A] was removed from the classroom, [child A] was checked for injuries emotional or physical (none found)." The center's representative stated that child A was not phased by the incident and was not observed crying. 2. The center's representative revealed to the inspector that there was an adult witness in the classroom when the incident occurred on 02/28/2019. The witness revealed the following to the inspector on 04/15/19: Teacher A "seemed frustrated" that child A kept playing with the light switch and Teacher A "yelled" at child A several times from across the room, "Do you hear me" and "Stop playing with the light switch." Child A walked over to the table where Teacher A was sitting. Teacher A then yelled, "You don't play with it, do you understand," "You don't play with it, do you hear me." Teacher A then "grabbed" child A's face so that child A can look at Teacher A. "[Child A] dropped to the floor and cried a little bit." "[Teacher A] grabbed [child A's] arm and yanked [child A] up and yelled at [child A] some more."

Plan of Correction: Upon initial report to center Director, Teacher A was immediately taken out of the classroom. After further investigation, the Teacher A did not return to work and is no longer employed with Kindercare.
