22VAC40-191 Background Checks (22VAC40-191)
The licensing inspector initiated an unannounced complaint inspection in the center on March 21, 2019 continued in the center on March 26, 2019 and completed on April 24, 2019 in response to a complaint received by the licensing office regarding staff qualifications/training and staffing/supervision. Review of center documentation, interviews with staff members and observations were conducted. Based on information gathered during the investigation, a preponderance of evidence does support the allegation regarding staffing qualifications/ training therefore the complaint is determined to be VALID. Standard #: 22VAC40-185-240-A Complaint related: Yes Description: Based on record review and staff interviews, the licensee did not ensure that all staff receive the required training by the end of their first day of assuming job responsibilities. Evidence: During inspection on March 21, 2019, it was confirmed by Center Management, Staff #1, Staff #2 and Staff #3 were working in the center on March18, 2019 and had not obtained the required trainings as listed below; 1 Job responsibilities and to whom they report; 2 The policies and procedures listed in subsection B of this section and 22VAC40-185-420 A that relate to the staff member's responsibilities; 3 The center's playground safety procedures unless the staff member will have no responsibility for playground activities or equipment; 4 Recognizing child abuse and neglect and the legal requirements for reporting suspected child abuse as required by 63.2-1509 of the Code of Virginia; 5 Confidential treatment of personal information about children in care and their families 6 The licensing standards which relate to the staff member's responsibilities. Plan of Correction: Center Management will ensure that all orientation is completed before a staff member begin in the classroom or their job.
Standard #: 22VAC40-185-240-B Complaint related: Yes Description: Based on record review and staff interviews, the licensee did not ensure staff were provided in writing required information. Evidence: During inspection on March 21, 2019, it was confirmed by Center Management, Staff #1, Staff #2 and Staff #3 were working in the center on March 18, 2019 and had not been provided with the following information in writing; 1 Procedures for supervising a child who may arrive after scheduled classes or activities including field trips have begun; 2 Procedures to confirm absence of a child when the child is scheduled to arrive from another program or from an agency responsible for transporting the child to the center; 3 Procedures for identifying where attending children are at all times, including procedures to ensure that all children are accounted for before leaving a field trip site and upon return to the center; 4 Procedures for action in case of lost or missing children, ill or injured children, medical emergencies and general emergencies; 5 Policy for any administration of medication; 6 Procedures for response to natural and man-made disasters. Plan of Correction: Center Management will ensure that all orientation and written information is given before a staff member begins in the classroom or their job.
Standard #: 22VAC40-191-60-B Complaint related: Yes Description: Based on record review and staff interviews, the licensee did not ensure an employee or volunteer of a licensed or registered child welfare agency must not be employed or provide volunteer service until the agency or home has the persons completed sworn statement or affirmation. Evidence: During inspection on March 21, 2019 it was confirmed Staff #2 was working in the center on March 18, 2019 and did not have a completed sworn statement or affirmation. Center Management confirmed Staff #2 began working in the center on 3-18-19 and they had not completed the statement prior to working in the the classroom with children. Plan of Correction: Center Management will ensure that the statement is completed.
