Comments:
An unannounced investigation was conducted in response to an incident that occurred on 3/11/2019 and that was self-reported to the licensing office on 3/12/2019 in regards to supervision of children during transitions. Children records and staff records were reviewed, classroom areas were inspected, and staff interviews were conducted. A preponderance of evidence supports the report and areas of non-compliance are identified on the Violation Notice. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on review of the center's policies and procedures, and staff interviews, it was determined that the center did not ensure that staff followed the center's own policies and procedures required by the standards, and the terms of the current license issued by the department. Evidence: 1. The center's name-to-face policy required that staff visually confirms children are present by matching the children's names on the CSR (Child Supervision Record) to the faces in the classroom at least every 2 hours and during any large class transitions, before a child transitions from one location to another location, and when they arrive at their final location to verify all children made the transition. It's also required that all transitions recorded on the CSR must be accurate and current at all times. Staff#1 and staff#2 stated that on 3/11/2019 they conducted a name-to-face head count before leaving the classroom; however, they did not conduct a name-to-face head count once they arrived at the playground. While the transition of the children from their classroom to the playground was recorded at 3:55pm on the classroom's CSR, Staff#1 and Staff#2 stated that after they logged in the time on the CSR, they took a few minutes to clean the classroom, and to give bathroom breaks to a group of children. It was also stated by both staff members, but not recorded on the CSR, that Staff#1 and Staff#2 did not exit the classroom at the same time. Staff#1 exited the classroom first with a group of children, Staff#2 and the remainder of the children joined them on the playground a few minutes later. 2. The center's supervision policy states that all individual and/or groups of children must be supervised at all times while in their care, and that children must not be left alone or unsupervised in classrooms, hallways, offices, lobbies, bathrooms, playgrounds, or vehicles. According to the CSR, on the day of the incident 3/11/19, the school-age children transitioned from their classroom to the center's playground at 3:55pm, at approximately 4:15pm Staff#2 was informed by adult#1 that Child#1 was sleeping inside the classroom, while the other children and two staff members assigned to this classroom were on the playground.

Plan of Correction: Retrained staff on child supervision record, transitions, name to face.

Description: Based on observations, interviews and a review of documentation, it was determined that the center did not ensure that all children 10 years of age or younger shall always be within actual sight and sound supervision of staff. Evidence: On the day of the incident 3/11/2019, a child was accidentally left inside the school-age classroom sleeping alone and unsupervised. Staff#1 and Staff#2 stated that they conducted a name-to-face count at 3:55pm, prior to transitioning from the classroom to the playground. Staff#1 and a group of children transitioned to the playground first, while Staff#2 waited for the remainder of the group to finish with bathroom breaks. Staff#2 and the remainder of the group then exited the classroom without the staff performing a name-to-face check once they arrived to the playground, leaving one child behind in the classroom. At approximately 4:15pm, when adult#1 entered the classroom, they found Child#1 sleeping on the floor towards the back of the classroom. Adult#1 immediately informed Staff#2 that a child was left behind in the classroom. Staff#1 and Staff#2 were not aware that Child#1 was not on the playground with the class. At this time Staff#2 walked Child#1 from the classroom to the playground to rejoin the group. According to the documentation gathered during the investigation Child#1 was left alone and unsupervised in the school-age classroom for approximately 15 to 20 minutes; however, both Staff#1 and Staff#2 stated that they did not go out to the playground at the time recorded on the CSR.

Plan of Correction: Staff member resigned.
