63.2 Child Abuse & Neglect

Comments:
The Fairfax Licensing Office received a complaint on 4/23/2019 concerning rough handling of a child in one of the Toddler rooms. While investigating the first complaint, a second complaint of rough handling in the Toddler 2 room was discovered. An unannounced complaint investigation was conducted on 4/24/2019 and 4/30/2019 jointly with a local government agency. Staff interviews were completed and records were reviewed on 4/24/2019. Observation of the center's video recording of 4/22/2019 in the Toddler 1 room and 4/23/2019 in the Toddler 2 room, staff records and additional staff interviews were completed on 4/30/2019. The preponderance of evidence supports the allegations pertaining to forbidden actions and care and protection in the Toddler 2 room and the complaint has been deemed valid. Complaint related: Yes
Description: Based on review of the center's recording system and staff interviews, staff failed to ensure the care, protection, and guidance of a child. Evidence: 1. On 4/23/19 at approximately 2:31pm to 2:33pm, Staff #2 was observed on video recording using her left arm to grab Child #1 by the child's left arm and carried the child approximately 10 feet across the classroom with the child's feet not touching the ground. 2. Staff #1 stated "she just moved him away from me to stop us from playing". Staff #1 stated she did not recall how Staff #2 moved Child #1 away from her. 3. At the time Staff #2 was roughly handling Child #1, Staff #1 was sitting down facing the staff and child and was within 10 feet of them and did not intervene to protect Child #1.

Plan of Correction: Staff are trained upon hire and were retrained on April 26, 2019 to include the appropriate handling of children and mandated reporting. These trainings will be done on an ongoing basis.

Description: Based on review of the center's video recording, staff used a forbidden action of roughly handling one child. Evidence: 1. The center's video recording of the Toddler 2 room on 4/23/2019 at approximately 2:31pm-2:33pm, at the end of naptime, was reviewed. Several children were awake in the classroom either sitting up on cots or standing on their cots. Staff #1 was sitting on the floor against the far wall of the classroom rocking and playing with Child #1 (Age: 20 months). Staff #2 was walking around the classroom and Staff #3 was facing away from all staff and children towards a cabinet. 2. Child #1 was observed on the video recording walking away from Staff #1 when Staff #2 approached Child #1, grabbed the child by both arms, and leaned down to the child. Staff #1 and Staff #3 were both facing towards Child #1 and Staff #2 at this time. Child #1 then ran back to Staff #1 and got in Staff #1's lap. Staff #2 approached Staff #1 and Child #1 and Staff #2, with her left arm, roughly grabbed Child #1 by the child's left upper arm and picked the child up off the ground. Staff #2 then picked up the child's cot with her right hand. Staff #2, with her left arm, carried Child #1, by the child's left arm, with the child's feet not touching the ground, for approximately 10 feet. Staff #2 then dropped the cot by the changing table and sat Child #1 down on the cot.

Plan of Correction: Staff are trained upon hire and were retrained on April 26, 2019 to include the appropriate handling of children and mandated reporting. Staff will continue to be trained in an ongoing basis.

Description: Based on record review and staff interview, the center does not have Virginia Child Abuse and Neglect Central Registry findings within 30 days of employment for all staff members. Evidence: 1. Staff #3 (Date of Hire: 10/5/2018) does not have Virginia Central Registry findings on file. Staff #3's file contained documentation the search request was sent on 10/24/2018, however, no follow up documentation was noted.

Plan of Correction: Document was sent on 10/24/18. Results were not received. Document was resent on May 8, 2019.

Description: Based on record review, the center does not have documentation of following up on an out of state Child Abuse and Neglect Central Registry search request within 45 days after a search request was submitted for a staff who resided outside the state of Virginia within the last 5 years. Evidence: 1. Staff #3 (Date of Hire: 10/5/2018) has resided outside the state of Virginia within the last 5 years. 2. Staff #3 had documentation in her file of a signed and notarized out of state Central Registry search completed for Maryland; However, no documentation was maintained regarding when the search request was sent and if the center followed up on the search request.

Plan of Correction: Document was sent on 10/24/18. Results were not received. Document was resent on May 8, 2019.
