Comments:
An unannounced inspection was conducted on May 17, 2019 in response to a complaint received by the Department on April 29, 2019 regarding forbidden actions and behavioral guidance. The licensing inspector was on site from approximately 11:15 AM until 4:15 PM interviewing staff, conducting observations at the center, and reviewing documentation. The preponderance of evidence gathered during the investigation supports the complaint, therefore the complaint is determined to be valid. Please complete the "plan of correction" and "date to be corrected" sections for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word "corrected" is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only. If you have questions, regarding this inspection, please contact the licensing inspector at 804-662-9092.

Description: Based on interviews and the review of documentation, the facility did not ensure behavioral guidance was constructive in nature and age and stage appropriate.

Evidence:

During interviews conducted on May 17, 2019; and in statements written on April 26, 2019; staff stated the following:

1. Four staff interviewed on May 17, 2019 reported the following: on April 26, 2019 Staff #3 directly stated to them individually that she had "plucked" Child #1 on the mouth for spitting.
2. Staff #4 reported being in the same classroom with Staff #3 while supervising children. Staff #4 reported hearing Staff #3 tell several children to stop running and to come stand beside Staff #3. Staff #4 reported hearing Staff #3 loudly state "You spit on me" to Child #1, then heard Child #1 crying. Staff #4 reported observing Staff #3 with her finger and her thumb together held away from Child #1's face. Staff #4 reported hearing Staff #3 state to the child, "I'm going to tell your mom I plucked you." Staff #4 stated that Staff #3 stated directly to Staff #4 that she had "plucked" Child #1 on the mouth for spitting.
3. Staff #6 reported that during a meeting on April 29, 2019; Staff #3 stated she did not "pluck" Child #1, but did threaten to "pluck" the child in the mouth for spitting.

Plan of Correction: Per administration, "The staff member was terminated. A mandatory staff meeting was held on 4/30/19 in reference to forbidden actions in childcare (review of policy). An updated forbidden actions policy was added to our Employee Handbook."

Description: Based on staff interviews and the review of documentation, the facility did not ensure roughly handling a child was forbidden.

Evidence:

During interviews conducted on May 17, 2019; and in statements written on April 26, 2019; staff stated the following:

1. Staff #4 reported being in the same classroom with Staff #3 while supervising children on April 26, 2019. Staff #4 reported hearing Staff #3 tell several children to stop running and to come stand beside Staff #3. Staff #4 reported hearing Staff #3 loudly state "You spit on me" to a child, then heard Child #1 crying. Staff #4 reported looking across the room and observing Staff #3 with her finger and her thumb together held in front of the child's face. Staff #4 reported hearing Staff #3 state to Child #1, "I'm going to tell your mom I plucked you." Staff #4 asked what had happened and Staff #3 stated she had "plucked" the child in the mouth for spitting.
2. Staff #2 reported Staff #3 approached Staff #2 on April 26, 2019 and stated "I popped (Child #1) in the mouth for spitting." Staff #2 reports speaking to Child #1 on April 26, 2019 and the child stated "my teacher popped me."
3. Staff #5 reported speaking to Staff #3 during a meeting on April 26, 2019. Staff #5 reports that Staff #3 stated she had "plucked (Child #1) for spitting in her face."
