Comments:
An investigation was initiated on 4/16/19 in response to a complaint received by the Eastern Regional Office regarding infant diapering and feeding procedures and supervision of children. An on-site inspection was conducted by two licensing inspectors on 5/7/19. Interviews with staff were conducted and documentation related to the complaint was reviewed. Additional telephone interviews with staff and collaterals were conducted on 4/30/19, 5/10/19 and 5/23/19. The investigation was concluded on 5/24/19.Based on the information gathered during the investigation, the portion of the complaint regarding supervision of children is found to be valid. Violations in the areas of administration and staffing and supervision are identified on the violation notice and were reviewed with the center director during the exit meeting on 6/3/19.

Description: Based on interviews and a review of the center's policies, the center failed to ensure that the operational responsibilities of the licensee shall ensure that the center's services are maintained in compliance with the center's own policies and procedures that are required by these standards. Evidence: The center failed to follow their written playground safety policy face-to-name procedures as demonstrated by the following incident: 1. The center's policy for playground safety states "Face-to-Name Transition Sheets must be utilized prior to bringing children out onto the playground, when arriving out on the playground, and upon returning to the classroom." 2. The center's policy for face-to-name procedures states that when a group transitions with the same teacher and has arrived at the final location, the teacher shall "circle each check mark to indicate that each child has arrived at their transition destination after seeing the child's face and saying their name." 3. On 3/25/19, child 1, age 2 years, was left alone and unsupervised on the playground after the rest of the class returned to the classroom with the teacher. 4. Staff 1 confirmed that she did not follow the center's policy for playground supervision and face-to-name procedures after returning to the classroom from the playground.

Complaint related: Yes
Description: Based on interviews, it was determined the center failed to file reports as follows: Any suspected incident of child abuse shall be reported in accordance with ? 63.2-1509 of the Code of Virginia. Evidence: 1. On 3/25/19, staff 1 left child 1, age 2 years, unattended on the playground for approximately 15 minutes. 2. Staff 1, staff 2 (assistant director) and staff 3 (center director), who are all mandated reporters, did not report the incident to the local agency as required. 3. Based on an interview with staff at the local child protective services agency on 05/1/18, a report of a suspected incident of child abuse was not made by the center.

Plan of Correction: The provider responded with the following: All staff at the facility are trained on their requirements of mandated reporting and consistently reemphasized. We do not believe that the incident described here rose to a level of intentional level of neglect as outlined in 63.2-1509 thus why it was not mandated reported.

Description: Based on interviews and a review of documentation, it was determined the center failed to ensure that when staff are supervising children, they shall always ensure their care and protection. Evidence: 1. On 3/25/19 at 11:15am, staff 1 was returning from the playground to the classroom with 8 children when child 1, age 2 years, was left unsupervised on the playground until approximately 11:30am. 2. Staff 2 (assistant director) stated she was working in the toddler classroom on 3/25/19 when she heard someone crying outside on the playground at approximately 11:30am. Staff 2 stated they opened the door to the playground and found child 1 alone on the playground crying. 3. Staff 1 stated she took the 2 year old class out to the playground at approximately 11:00am and came back inside through the toddler classroom door at approximately 11:15am. Staff 1 stated she had the children line up on the playground and she then did a face-to-name count before entering the center but stated she did not count the children or do a face-to-name after returning to the classroom. 4. Staff 1 stated she did not notice child 1 leave the line while on the playground and stated she was unaware that child 1 had not returned to the classroom with her until she was leaving the center for her break and was told by the director that child 1 had been found alone on the playground.

Plan of Correction: The provider responded with the following: Staff 1 no longer works for the company. Retraining on supervision, face to name process and procedures was completed by 4/5/2019. Any deviation from any of our policies and procedures will result in disciplinary action up to and including termination of employment

Complaint related: Yes
Description: Based on interviews, it was determined the center failed to ensure that all children under 10 years of age always shall be within actual sight and sound supervision of staff. Evidence: 1. On 3/25/19, child 1, age 2 years, was out of sight and sound supervision of staff on the center's playground for approximately 15 minutes. 2. Staff 1, staff 2 and staff 3 all confirmed that child 1 was left alone and unsupervised on the playground on 3/25/19.
