Comments:
An unannounced complaint inspection conducted jointly with local agency was initiated on May 7, 2019, in response to a complaint regarding staffing and supervision and programs. Based on observation, there was a preponderance of evidence to support the allegation therefore the complaint is deemed VALID. Exit interview conducted with Owner/Program Director.

Violations:
Standard #: 22VAC40-185-340-A
Complaint related: Yes
Description: Based on interviews and observation, the licensee did not ensure care, protection and guidance of children in care. Evidence: During the interview with the local agency , Staff #1 confirmed she was left in the building alone the morning of May 1, 2019. Staff #1 unable to provide further information about the number of children in care on the date. On May 7, 2019 staff #1 was observed alone with 22 children in the building ages 3 months to 10 years of age. Staff #1 also confirmed she has left children alone in classroom C while she had other children in the hallway or outside the building waiting to leave for school . Staff#1 stated sometimes she would leave mature child alone with children as helper. Staff #1 stated she would sometimes stand in the office to be able to see both groups of children. Child #3 (11 years) stated she was left alone in the classroom C with children as a helper. Staff #2 confirmed that staff #1 is alone daily with children between 7:30am - 8:00am .

Plan of Correction: Staff #1 is no longer employed at the center. The staff have been retrained and trained in proper supervision. New employees were hired.

Complaint related: Yes
Description: Based on observation and interviews , the licensee did not ensure children under 10 years of age always shall be within actual sight and sound supervision of staff, except that staff need only be able to hear a child who is using the rest room. Evidence: Child #2 was observed leaving classroom C, walking through the office and down the hallway to get to the restroom. Staff #1 was separated from the child by a room and hallway and was unable to hear the child using the restroom.

Plan of Correction: If the children are in classroom C they will use the restroom in the infant room. The staff have been trained to ensure the children are in sight and sound supervision at all times.

Complaint related: Yes
Description: Based on observation, the licensee did not ensure for children from birth to the age of 16 months: one staff member for every four children. Evidence: Between 7:30-8:30 am staff #1 was observed alone in building with 22 children ( 3 months to 10 years of age) in classroom C.

Plan of Correction: The director hired four new staff since May 7, 2019. The director was in the processes of hiring staff during the incident. Other staff schedules were changed to keep in ratio.

Complaint related: Yes
Description: ased on interview conducted with local agency , facility did not ensure staff do not commit the forbidden action of threats of physical punishment and roughly handling. Evidence: Staff #1 confirmed she had verbally threatened children with a fly swatter and threatened to "pop" them. Staff #1 said she never "popped" a child or hit a child with a fly swatter. During the interview with staff #1, she demonstrated and confirmed she guided /pushed child #1 with her hand cuffed around the back of the neck to the office on May 1, 2019 because child #1 was running around. Child #1 revealed in interview with local agency that staff #1 "squeezed the back of his neck" and and "bonged"/"hit" him on his shoulder.

Plan of Correction: Staff #1 is no longer employed at the center. The staff have been trained and retrained on behavioral guidance.
