63.2(17) License & Registration Procedures
An unannounced monitoring inspection was conducted on 06/13/2019 in response to serious injuries occurring on 05/21/2019 and 06/05/2019. Based on the information gathered, which included staff interviews, a review of records & written policies , a review of video for the 06/05/2019 injury and review of the facility and outdoor play area, violations were observed in the areas of building maintenance, care of children and administration. These violations were reviewed with administrative staff at the exit interview and are listed on the violation notice.
Standard #: 22VAC40-185-40-E Description: Based on policy review and interview, the center failed to ensure that the operational responsibilities of the licensee shall include, but not be limited to, ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards. Evidence: 1. The playground safety plan for the center states, "Before the children go onto the playground an inspection will be done daily by staff to ensure that the playground is safe and free of any hazards." The plan additionally states, "Immediately remove any broken toys and equipment from the playground." a. Staff 1 and staff 2 stated that the playhouse was in disrepair when the children went outside to play on the afternoon of 05/21/2019. Both staff indicated that one of the panels was on the ground and that no staff thought to remove this panel from the playground which resulted in child 1, age seven years, tripping over the panel and breaking her ankle. Plan of Correction: Effective 7/1/2019, we will update our playground checklist to remove all items that are in disrepair. Management will also conduct periodic inspections to the playground.
Standard #: 22VAC40-185-40-J Description: Based on record review and interview, the center failed to ensure that injury prevention procedures shall be updated at least annually based on documentation of injuries and a review of the activities and services. Evidence: 1. The injury plan for the facility was last updated in 2016 according to written documentation provided by administrative staff. a. Administrative staff confirmed that the injury prevention plan had not been updated since 2016. Plan of Correction: The injury prevention plan will be completed by 7/12/19. We will do our annual plan every May to ensure that we keep up with annual requirements.
Standard #: 22VAC40-185-270-A Description: Based on staff interview, record review and observation, the center failed to ensure that areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. Unsafe conditions shall include, but not be limited to, splintered, cracked or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting or breakage of any equipment; head entrapment hazards; and protruding nails, bolts or other components that could entangle clothing or snag skin. Evidence: 1. Child 1 was running on the playground on 05/21/2019 at approximately 5:40pm when she tripped over a section of the outdoor play house that was lying on the ground. This resulted in a break to child 1's left ankle. a. The plastic playhouse was disassembled on the playground during outdoor play on the afternoon of 05/21/2019 according to staff 1 and staff 2. b. Staff 1 stated that the playhouse had fallen apart and that it had been placed up against the fence however, the sections of the playhouse had fallen on the ground. c. Staff 2 stated that the four sections of the playhouse had fallen on the ground and that the play house had been in disrepair "for awhile." d. Staff 3 stated that the play house was "falling apart" but was not removed from the playground until after child 1 broke her ankle. 2. During a review of the facility on 06/13/2019 the following safety hazards were observed: a. The dividers in the two year old classroom have two missing covers , measuring approximately 5 inches x 3 inches, located toward the bottom area accessible to children. This has resulted in exposed metal brackets with sharp edges. b. The dividers in the school age classroom have two missing covers , measuring approximately 5 inches x 3 inches, located toward the bottom area. Some type of crumbling white dry wall type substance has been exposed and several small chunks of this substance was observed on the floor. c. An area of sheet vinyl flooring, located in the entry hall to the rear bathroom which is used by children, is torn and peeling in an area measuring approximately 7 inches x 7 inches. This is a trip hazard. Plan of Correction: As previously stated, we will update our playground checklist to remove all items that are in disrepair by 7/1/19. Management will also conduct periodic inspections to the playground. We will make all necessary repairs to be in compliance by 7/31/19.
Standard #: 22VAC40-185-340-A Description: Based on staff interviews, the center failed to ensure that when staff are supervising children, they shall always ensure their care and protection. Evidence: The facility failed to provide for the protection of children as demonstrated by the following incident occurring on 05/21/2019 at approximately 5:40pm when a seven-year old child was injured and required medical attention: 1. Staff 1, staff 2, staff 3 and staff 4 stated that the playhouse, on the playground, had been falling apart for some time and was in disrepair on 05/21/2019 when multiple groups of children were taken outside for outdoor play. a. Staff 1 and staff 2 indicated that one of the panels was on the ground when the children were taken outside for outdoor play on the afternoon of 05/21/2019. 2. All staff interviewed stated that no one thought to remove the broken play house from the playground until after child 1 tripped over one of the panels and broke her ankle. Plan of Correction: The playhouse has been completely removed from the outside area. Management has gone over playground safety procedures and the importance of notifying management of any hazardous conditions on the play area with all staff. This has been done on 6/28/19.
