63.2(17) License & Registration Procedures

Comments:
An unannounced inspection was completed on June 19, 2019 from approximately 11:00a.m. to 1:30p.m. in response to a complaint received on May 23, 2019 regarding forbidden actions, staff records and program directors. The investigation was initiated and completed on June 19, 2019. Staff, children and classrooms were observed, staff was interviewed and staff's records were reviewed as related to the complaint. The Director and Director of Administration were available for the inspection and the Director was present for the exit interview at which time the inspection findings were reviewed and an Acknowledgement of Inspection form was signed and left with the licensee. The complaint is determined to be valid for background checks and not valid for forbidden actions and program directors. Complaint related: No
Description: Based on a review of staff records, the licensee failed to ensure that a staff submit documentation of a negative tuberculosis screening no later than 21 days after employment or completed within 12 months prior to employment for two of three staff. Evidence: 1. Staff #1's record, hired on March 28, 2019, contained a tuberculosis screening/test dated April 25, 2019. Staff #2's record, hired May 20, 2019, contained no tuberculosis test/screening. 2. Therefore these test/screenings were not completed within the required time frames. 3. Administrator #1 acknowledged these screenings/test were not completed within the required time frames of hire and indicated that the health department in the area only administers the tests on certain days and therefore this prevents staff from obtaining them as required.

Plan of Correction: The Director will make sure all staff are getting TB tests scheduled with in the first 21 days of employment.

Description: Based on observation, the licensee failed to post the most recent inspection of the facility. Evidence: 1. Upon observation, the findings of the most recent inspection were not posted at the center. 2. Administrator #1 acknowledged these findings were not posted as she was not aware they needed to be until the plans of correction were added.

Plan of Correction: This was corrected on site as the most recent inspection findings were posted.

Complaint related: Yes
Description: Based on review of staff records and interview, the licensee failed to obtain a fingerprint results prior to employment for three of three staff. Evidence: 1. Staff #1's record, hired on March 28, 2019, contained fingerprint results dated April 3, 2019. Staff # 2's record, hired on May 20, 2019, contained fingerprint results dated May 24, 2019. Staff #3's record, hired on April 6, 2019, contained no fingerprint results. 2. In an interview with Administrator #1, she indicated she was unaware that staff cannot begin to work before fingerprint results are received and advised she thought staff needed fingerprints before working alone with children and not prior to orientation training. In an interview with Administrator #2 she indicated that staff are paid for on boarding and orientation training. Therefore, fingerprint results were not obtained prior to employment as required.

Plan of Correction: These employees completed their background checks and fingerprinting before their first day working with children. The online employee orientation includes scheduling a fingerprint appointment. We will be revisiting the order in which we complete the on boarding process so that employees schedule fingerprints and results are confirmed before the online training is started.
