An unannounced complaint inspection was conducted today 5/29/2019. The complaint was received on 5/28/2019 in the Licensing office. The preponderance of evidence gathered during the investigation found that the complaint was not valid. Violations were found in other areas of the standards. A plan of correction was not received by the center on July 12, 2019.

Standard #: 22VAC40-185-350-C Complaint related: No Description: Based on observation the center failed to ensure that when children are regularly in ongoing mixed age groups, the staff-to-children ratio applicable to the youngest child in the group shall apply to the entire group. Evidence: 1. Upon arrival at 4:05 P.M. there were 17 children downstairs with three staff present. The youngest child in the grouping was 21 months old. At 4:14 P.M. there were 20 children with three staff. The required ratio is one staff to five children. Five staff were required at this time. At 4:25 P.M. 10 children were taken outside and ratio were met. 2. Verified through interviews with staff # 1 the mixed age grouping occurs every day from lunch time to parent pick up. Standard #: 22VAC40-185-370-1 Complaint related: No Description: Based on observation, the center failed to ensure that all infants 16 months and younger were placed on their backs to sleep. Evidence: 1. Upon arrival infant # 1 was sleeping on the floor. Staff moved the infant (8 months old) to the crib and was placed on their stomach to sleep. Plan of Correction: Not available online. Standard #: 22VAC40-185-410-2 Complaint related: No Description: Based on observation, the center failed to ensure that children were not placed in an enclosure in a small confined space or any space that a child can not freely exit himself, however, this does not apply to the use of equipment such as cribs, play yards, high chairs, and safety gates when used with children preschool age or younger for their intended purpose. Evidence: 1. Child # 2 (2 1/2 year of age) was observed in a crib. The LI asked staff why the child was in the crib? The staff stated "the child was in time out". 2. Verified with staff why a chair was not used for the 2 1/2 year old , the child would not stay in the chair. Plan of Correction: Not available online. Contact Inspector for more information.
