Comments:
An unannounced Complaint Inspection was conducted today in response to a complaint that was received by the Virginia Department of Social Services, Licensing Division on June 19, 2019. Interviews were conducted with staff relating to allegations of a lack of care and protection and roughly handling a child. Based upon a preponderance of evidence, the information gathered during the investigation supports the allegations and the complaint is determined to be valid. Please complete the columns for 'description of action to be taken' and 'date to be corrected' for each violation cited on the violation notice, and then return a signed and dated copy to the licensing office within 24 business days. Standard #: 22VAC40-185-340-A
Complaint related: No
Description: Based on staff interviews and written statements, the faciltiy failed to ensure that when staff are supervising children, they are always ensuring their care, protection and guidance. Evidence: Identified that Staff 1 was speaking loudly to Child 1 to put clean up their activity that had spilled on table and the floor and then to get off of a table. Child 1 did not fully comply with Staff 1's request and was still spilling rice from the activity onto the floor. Staff 1 grabbed Child 1, tightly, around their biceps and lifted the child off of the table and onto the floor. Child 1 screamed in pain and Staff 1 quickly apologized to the child for grabbing their arms too tightly, leaving a small red mark on the child's arm.

Plan of Correction: Staff member was retrained on positive guidance and attachment. Review of video did not show staff member roughly grabbing child. Child was sitting on top of the table and staff member asked child several times to get down fromthe table before assisting the child down. All staff members have been retrained on positive guidance.

Description: Based on staff interviews, staff written statements and child interviews; the facility failed to ensure that following actions or threats are forbidden: physical punishment, striking a child, roughly handling or shaking a child, restricting movement through binding or tying, forcing a child to assume an uncomfortable position, or exercise as punishment. Evidence: Staff 1 roughly handled Child 1 while removing Child 1 from a table, after Child 1 refused to comply with commands; leaving a small mark on Child 1's arm and causing Child 1 to cry from the pain caused by Staff 1's tight grip on the child's biceps.

Plan of Correction: Staff member was retrained on positive guidance techniques. Staff member did not intentionally cause injury to child. Review of video did not show staff member roughly grabbing the child, but merely assisting the child off of the table. All staff members have been retrained on positive guidance.
