Technical Assistance:
We discussed where information can be found regarding the transportation safety laws in Virginia.

Comments:
An unannounced inspection was conducted today between approximately 10:00am and 11:30am in response to a complaint received on 7/17/2019. Interviews were conducted, policies and records were reviewed. There was a preponderance of evidence to deem the complaint valid. Areas of non-compliance are identified in the Violation Notice. Standard #: 22VAC40-185-340-A
Complaint related: Yes
Description: Based on interviews and policy review, the staff failed to ensure care and protection of 2 children in care when transporting them on a field trip.

Evidence: 16 children went on a field trip July 16, 2019. The school bus had room for 14 children. Staff A transported the remaining 2 children in a personal vehicle, without the proper child restraint device. A child restraint device is a device used to protect a child in a motor vehicle. According to the Code Virginia [Section 46.2-1095], Child 1 (age 6 years) and Child 2 (age 6 years) require a child restraint device up to age eight for their protection.

Plan of Correction: Our school's transportation safety policies and procedures have been reviewed and are in the process of being updated. Booster chairs are being bought to keep on-site for emergencies. Staff and parents will be given information about transportation safety in relation to various ages and the current law.

Description: Based on interviews, the facility did not ensure Virginia state statutes about safety belts and child restraints are followed when transporting 2 children.

Evidence: Child 1 (age 6 years) and Child 2 (age 6 years) were transported on a field trip by Staff A in a personal vehicle, without the proper child restraint device. According to the Code Virginia [Section 46.2-1095], Child 1 (age 6 years) and Child 2 (age 6 years) require a child restraint device up to age eight for their protection.

Plan of Correction: The children were transported using seat belts, but not in booster seats, as required by Virginia law. We will review the current laws and abide by them on future field trips.
