Comments:
An investigation was initiated on 6/4/19 in response to a self reported incident on 7/3/19 regarding inappropriate discipline of a child by a staff person. An unannounced on-site inspection was conducted on 6/13/19 and interviews with staff were conducted. Documentation and records related to the incident were also reviewed. The investigation was concluded on 7/12/19. Based on the information gathered during the investigation, the incident is determined to be valid. Violations in the areas of administration and programs are identified on the violation notice and were discussed with the center director during the exit interview on 7/19/19.

Violations:
Standard #: 22VAC40-185-140-A
Description: Based on record review and interview, the center did not ensure that each child shall have a physical examination by or under the direction of a physician before the child's attendance or within one month after attendance. Evidence: 1. The record for child 1 does not contain documentation of a physical examination. Child 1 has a date of enrollment of 4/29/19. 2. The center director confirmed that the record for child 1 does not contain documentation of a physical examination

Plan of Correction: The center responded with the following: We have retrieved a physical from the doctor.

Standard #: 22VAC40-185-60-A
Description: Based on record review and interview, the center did not ensure that children's records contain all the required information. Evidence: 1. The record for child 1 contains only one name, address, and phone number of a designated person to call in an emergency if a parent cannot be reached, where two are required. 2. The center director confirmed that the record for child 1 contains only one emergency contact.

Plan of Correction: The center responded with the following: We have updated our emergency contacts.

Standard #: 22VAC40-185-410-1
Description: Based on interviews with staff, the center did not ensure that physical punishment, such as roughly handling a child, is forbidden. Evidence: 1. During the week of May 27, 2019, staff 1 was witnessed rough handling child 1 on two separate occasions by two different staff members. 2. Staff 2 stated she was working in the 3 year old classroom with staff 1 when she witnessed staff 1 grab child 1 by his upper arm after he had hit another child. Staff 2 stated child 1 "snatched" his arm away from staff 1 and staff 1 then grabbed child 1 a second time by his lower arm. Staff 2 stated staff 1 was yelling at child 1 stating "you don't hit." 3. Staff 3 stated she was working in the 4 year old classroom adjacent to the 3 year old classroom and heard staff 1 yelling at child 1 due to him hitting other children and running in the classroom. Staff 3 stated she went over to see what was going on and observed staff 1 take child 1 by both arms and walk him over the wall by the door. Staff 3 stated staff 1 then "forcefully" sat child 1 down on the floor and the back of child 1's head hit the bulletin board on the wall. 4. In a written statement dated 6/3/19, staff 1 stated that on Friday, 5/31/19, child 1 had been hitting, spitting and throwing toys in the classroom. She stated after trying to get child 1 to stop the behavior, he grabbed a chair and spit on her. Staff 1 stated she then grabbed him "to sit on the floor in the entrance but he was trying to fight back by pulling himself away and he accidentally scratch his arm with sharp nails and left a mark."

Plan of Correction: The center responded with the following: Staff member is no longer with us and all staff has be re-trained on positive guidance.
