Comments:

An unannounced monitoring inspection was conducted on 07/18/2019 in response to a self-reported incident that occurred on 07/12/2019 involving a scratch on a child. Based on the information gathered, which included staff interviews, child interview, a review of records and written policies and a review of the classroom, violations were found in the areas of supervision and behavior guidance. The violations are listed on the violation notice and were reviewed with the program director at the exit interview.

Standard #:	22VAC40-185-340-A
Description:	Based on staff and child interview and record review, the center failed to ensure the care and protection of a child based on the following incident which occurred on 07/12/2019. Evidence: 1. The enrollment record for child 1, age four years, contained written information from the parent that provided developmental information regarding the child's challenging behavior. Nevertheless, staff indicated there was no system in place to deal with a behavior incident beyond calling the parent. All staff interviewed stated they had received no training or information regarding how to handle child 1 in the event of a behavior incident. a. The parent of child 1 indicated that the center had not requested further information as to how to best handle her child in the event of an occurrence of challenging behavior b. Administrative staff stated they had not asked the parent of child 1 for effective strategies in the event of a behavior challenge by child 1. 2. When child 1 had a behavior challenge on 07/12/2019 staff 1 physically picked up the child, while she was screaming, kicking and flailing her arms and lifted her over the classroom gate and placed her on the floor. a. Staff 2 picked up child 1 and moved her to another classroom while child 1 continued kicking, screaming and flailing her arms. b. Staff 3 also picked up child 1 in order to prevent her from running out of the room. 3. The actions of staff resulted in child 1 obtaining a scratch on her waist.
Plan of Correction:	On August 5th, we've partnered with the Infant and Toddler Specialist Network to provide our organization with on-site trainings for the next several months. This organization will assist us with improving practices involving managing children with challenging behaviors.

Description:	Based on interview and interviews, the center failed to ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts as demonstrated by the following incident that occurred on 07/12/2019: Evidence: 1. Child 1, age four years, engaged in a behavior challenge at approximately 12:30pm when she was redirected from a conflict over a toy with another child. a. Staff 1, who was responsible for child 1, stated that child 1 threw herself on the floor and was screaming in a loud voice while kicking at the classroom gate and grabbing at a chair. b. Staff 1 stated she needed to remove child 1 from the classroom for her safety. "I picked her up to try and get her over the gate....She held onto the gate." c. Child 1 stated that staff 1 picked her up by the waist: "My teacher put her nails in me and it hurt a little bit." 2. Child 1 was picked up a second time by staff 2 , while she continued to kick, scream and flail her arms , and physically moved her into the care of staff 3 who was in the school age classroom. 3. Staff 3 stated that child 1 continued to kick and scream and made an attempt to leave the classroom. Staff 3 stated, "She was kicking and moving her body...trying to get out of my grib...so I had to hold her....I didn't want her to run out of the room....there was no one to chase her.." 4. The process of being physically restrained and moved by three staff resulted in child 1 being scratched on her waist. This scratch was approximately one inch in length and did break the skin leaving a scab. 5. The actions of staff 1, staff 2 and staff 3 did not redirect child 1 to appropriate behavior or resolve the conflict.
Plan of Correction:	With on-site trainings and support from outside sources we will be working on improving our behavior action plans to avoid reoccurrence of such situations.
