The following TA was provided: 22 VAC 40-185-350.D (ratios during designated rest and sleeping periods) - Ratios should not be doubled until the vast majority of children are settling down and resting.

Comments:
The licensing inspector conducted an unannounced complaint inspection in response to a complaint received by the department on 06/13/2019 regarding rest time ratios, special services, staffing, and the supervision of children. The investigation was initiated on 07/03/2019 and completed on 07/26/2019. On 07/03/2019, the inspector was on site from approximately 12:35pm to 2:57pm. Interviews were completed, observations were made at the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation supports part of the allegation, therefore the complaint is determined to be valid. See the violation notice for more details. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the day of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Description: Based on information obtained during interviews on 07/03/2019, the center did not ensure that for two-year-old children, the staff-to-child ratio of one staff member for every eight children was maintained. Evidence: 1) During interviews, the center's staff reported that in the two's class, during the transition between lunch and the designated rest time, there have been between 13 to 14 2-year-old children awake and eating lunch when the second staff member goes on break, leaving the children in the care of one staff member. For two-year-old children, the staff-to-child ratio is one staff member for every eight children.

Plan of Correction: Per the Center: "In my opinion, this is a false claim as no teacher is allowed to leave for a break until all kids are on their cots. This has been addressed with the two's room teachers. If there is a ever a complaint of this nature, I hope ratio charts, break schedules, and sign in sheets are all taken into consideration. I will personally be monitoring the two's room specifically to make sure they are following all ratios and staying in ratio at all times."
