Comments:
The licensing inspector conducted an unannounced inspection in response to a self-reported concern regarding supervision that occurred at the center on June 26, 2019. The Department was notified of the incident on June 26, 2019. The investigation was initiated on July 9, 2019 and completed on August 7, 2019. On July 9, 2019, the licensing inspector was on site from 10:40am to approximately 12:30pm. Interviews were completed, observations were made in the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation validates the self-reported incident. See the violation notice for more details. Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the Violation Notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s). Violations:
Standard #: 22VAC40-185-40-E
Description: Based on a review of policies and procedures, interviews and a review of documentation on 07/09/19, the center did not ensure that the center's activities and services were in compliance with the center's own policies and procedures related to supervision that are required by the standards. Evidence: 1) During interview, Staff #6 reported that on 06/26/19, Child #1 (2-year-old) was found alone and unsupervised on the Discovery Preschool (DPS) playground. Staff #1 and Staff #2 were supervising the DPS class. Staff #6 reported that she was doing Child Supervision Record (CSR) checks in the DPS classroom at 4:00pm. The CSR form reviewed by Staff #6 indicated there should have been a total of 15 children in the classroom, but there were only 14 children present. Staff #6 reported that Staff #1 and Staff #2 "admitted they didn't do a name-to-face on CSR, they only counted heads" when they returned from the playground at 3:51pm. Staff #6 reported that between 4:01pm and 4:04pm, Staff #5 returned Child #1 to the DPS classroom. 2) On 07/09/19, the licensing inspector reviewed a Coaching Form for Staff #1 dated 07/01/19 that stated: "On Wednesday, June 26th [Staff #1] was holding ratio in DPS around 4pm. The CSR stated that there were 15 children however [sic] there were only 14 children in the room. [Staff #1] assumed that a name-to-face was being recorded at 3:51pm when returning from the playground. She did not verify that a name-to-face transition had been done." 3) On 07/09/19, the licensing inspector reviewed a Coaching Form for Staff #2 dated 07/01/19 that stated: "On Wednesday, June 26th [Staff #2] was holding ratio in DPS around 4pm. The CSR stated that there were 15 children however [sic] there were only 14 children in the room. [Staff #2] stated that she did not do a name-to-face at 3:51pm when returning from the playground, but did a head count. At 4:01pm, [Child #1] was discovered by a Preschool teacher alone on the playground. She was returned to the DPS classroom shortly thereafter. [Staff #2] was unaware that [Child #1] was not in attendance in the classroom until she was returned by another teacher. Upon [Child #1]'s return, she was marked as the missing child on the CSR." 4) The center's supervision of children policy requires that "all individuals and/or groups of children must be supervised at all times while in our care; that "children must not be left alone or unsupervised in classrooms, hallways, offices, lobbies, bathrooms, playgrounds, or vehicles;" and that "name-to-face attendance (visually confirming children are present by matching the names on the CSR to the faces in the classroom) must be taken at least every 30 minutes and during any large class transitions (i.e. going outside to the playground, loading children onto a van for a field trip, moving an entire class into an enrichment room to watch a puppet show, etc.)."

Plan of Correction: Per the Center: "-All staff will be retrained on KCE policies on supervision and transitions. -Management will continue to monitor and work with staff on CSR usage and accuracy. -Management will complete observation classroom routines and transitions to provide feedback. - Administrative actions will be taken if any staff continue to not follow our supervision standards. District Leader and Corporate Team Commitments: -District leader will do unannounced visits to the center to ensure that staff are being retrained and that observations are completed. -District Leader will make sure any new management is trained CSR and supervision practices. -Program Quality Business Partner will complete a 90 day follow up with teachers and management to ensure that an implementation of classroom management activities are taking place."

Standard #: 22VAC40-185-340-F
Description: Based on interviews and documentation reviewed on 07/09/19, the center did not ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff. Evidence: 1) During interview, Staff #3 reported that on 06/26/19, she found Child #1 (2-year-old) alone and unsupervised on the Discovery Preschool playground at approximately 3:58pm. Staff #3 and Staff #4 reported the Preschool class went outside to the neighboring playground at 3:55pm. 2) During the inspection, the licensing inspector reviewed an incident report dated 06/26/19 that stated: "During transition from outside [Child #1] was left on the playground. A teacher on the neighboring playground had eyes on her and asked [Child #1] to come to her when another teacher observed from her classroom window and brought [Child #1] inside." 2) During interview, Staff #6 reported that on 06/26/19, the Discovery Preschool class transitioned inside from the playground at approximately 3:51pm. Staff #6 reported that approximately ten minutes after the Discovery Preschool class had been inside, Staff #5 returned Child #1 to the classroom. Staff #1 and Staff #2 were not aware that Child #1 was out of sight and sound supervision until they were notified by Staff #5. It is estimated that Child #1 was out of sight and sound supervision for approximately eight to ten minutes. Children under 10 years of age always shall be within actual sight and sound supervision of staff.

Plan of Correction: Per the Center: "-Teachers and Center management will review the licensing standards regarding supervision within sight and sound. -Additional resources will be given to staff to help with classroom management and systems to support supervision in discovery preschool age groups. -Management will continue to have conversations with staff around the importance of compliance and supervision safety. -All new staff coming in will observe supervision and transition activities in classrooms prior to being in ratio. District Leader and Corporate Team Commitments: -District leader will do unannounced visits to the center to ensure that staff are being retrained and that observations are completed. -District Leader will make sure any new management is trained CSR and supervision practices. -Program Quality Business Partner will complete a 90 day follow up with teachers and management to ensure that an implementation of classroom management activities are taking place."
